Can you sub-let a bought flat, in a no-sub let block?

Hi, basically the person under me flat told us that the block of flats we live in is a 'no sub let' building.

He was wondering why we where privately renting this flat because he couldn't rent his out because of the rules.

I don't know if he owns his flat or not, but i do know the landlord of this house does own it.

Does anyone know even when the rules are that you can't sub-let, does that mean bought out flats/houses aswell?

  • Everything depends on the conditions in your landlord's lease. Which you are not party to, so are not in a position to find out. Some developments prohibit sub-letting but do not always enforce it.

    Now that your neighbour knows your landlord is sub-letting they could start interfering by informing the freeholder.

    Though it's hardly interfereing if he has a material interest

    I was recently considering bidding on a repo in a no sub letting block and the OOs that bid on it paid 10-15% less than a BTLer would have.

    Covenants in the long lease apply to all leaseholders. If you are in England or Wales your landlord probably does not own the flat outright (freehold), they are a longhold tenant (leasehold) so any letting is technically subletting. Many landlords ignore covenants in the long lease/ don't seek the consent of the freeholder/ don't inform the buildings insurer.

    Agree with all the above, though as bitter says, as a tenant you are not party to the lease so have no way of seeing it to check, other than to ask a leaseholder (eg your landlord or the leaseholder downstairs) if they are willing to give you a copy.

    They are unlikely to agree.

    And as there is nothing much you can do (except leave when your tenancy ends) there is little point.
