    Do you have a contract. If so what does it say in your terms and conditions of employment about getting paid. Mine states I will be paid by cheque by the 25th of every month.

    Do you also have a grievance procedure? Are there other employees? How are they being paid?

    Sorry for the questions but I would think your best route is raise a formal grievance by way of a letter, ring ACAS for help wording the letter. It is illegal not to pay you and you can sue for non payment of wages. Request that the bank charges are reimbursed to you.

    If this gets you nowhere I am afraid the only option is a Tribunal.. You need to put your foot down with your employer if he is not going under, but just a tight wad - OR go and find alternative employment. I know what would do!!

    It is unlawful to bounce a cheque.

    You have two choices - make a small claims court claim for the money owing or go to an Employment tribunal.

    Personally I'd go for the small claims court. You can do it through Moneyclaim Online, it is quick, you are entitled to claim interest on the money from the date of the first cheque and hopefully the company won't want a county court judgement registered against it as this will cause problems if it tries to get credit.

    You need to write to the company informing them that you require the money owed to be paid in CASH within 48 hours, failing which you will commence court proceedings for the full amount owed, plus interest and court costs.

    If he doesn't pay up, make the claim. The process is easy and it takes you through it step by step. You need to state exactly what has happened in date order.

    Sorry, just re-read you original post.

    If you are still out of work, then you are entitled to claim constructive dismissal providing you have at least one year service with the company.

    In that case, you'd be better off going to a tribunal as you can claim compensation for loss of employment as well as the unpaid wages.

    Your claim would be 'constructive unfair dismissal, breach of contract, and unlawful deduction from wages'

    You can get the claim forms from most job centres and some CABx. You need to set out exactly what happened, and state clearly that your employer's conduct in failing to pay your wages left you with no alternative but to resign.

    HI, Just read your post, if you put the cheque into your account and when you checked the account, the money from the cheque was there and you took the money out, how can the bank then tell you that the cheque has bounced?

    did I understand wrong????
