If the landlord has been careful not to issue any receipts or keep any verifiable records of the sums paid they are going to have trouble convincing a court of their position.
Landlord turns up in court and says "Your honour, this tenant owed me three months rent by the time he left".
Tenants says "No, I don't. It was only a couple of weeks".
Court official says "Do either of you have any documentary evidence of your position?"
Both reply "Erm no, I don't"
Court official "Why are you wasting our time? The landlord can pay his own costs. Good afternoon"0 -
thank you for all the replies. i will be moved out to a new address in the next couple of weeks. the landlord himself knocked on mydoor with letters saying i had to sign to show that i was behind on rent. I refused to sign them and he shoved past me and took my laptop. I have now called the police as this is THEFT. he has not court order to say he has the right to take my belongings. Police have agreed and arrested him0

And can you get any records to show payment - bank statements showing the money withdrawn at intervals, texts indicating that you have the money, or that you have paid?If you've have not made a mistake, you've made nothing0 -

i have not got the laptop yet but should soon i hope. I can go to my bank statement and show that i was taking cash out of the amount he said each month. as i am now paying by electronic direct into his account it marks each one as rentplus my name. So this should help, i wanted to do this in the first place but it took him months to get this sorted. I have spoken to the other 3 tenants and neither of them has ever been given receipts fr their rent either. 2 of them have been accused of being in arrears too.
he did say when getting me to sign the letters that when i first moved in and was on housing benefit that i agreed to pay more and backdate this to when i first moved if i got a job. This is how he thinks im 3 months behind. I did not agree to this and its him just trying to get more money.0 -

Time to pack up and remove all your belongings from landlord's house while he's being processed at the police station. Hope you're living light so can fit everything into a taxi. Go before he gets back; you can find a B&B tonight and somewhere else to lodge on Gumtree.
..Current landlord is not going to be in a good mood with you if you're still at his home when the police release him.
Normally I'd advocate sorting things out, but in this situation it's more important to avoid violence being done to one's person.0 -
Move out now would be my advice, and I mean now as in today.0
