Another "No Show" For Sobell / Roxburghe

This has just popped up on CAG:-

http://www.consumeractiongroup.co.uk/forum/showthread.php?388582-Roxburghe-Graham-White-lose-Again-in-court%2826-Viewing%29-nbsp

"The day after receiving her bundle the old vampire tried to adjourn it, however the judge was having none of it and left a message on Graham White solicitors answer machine (who we all know is not there), and told him to appoint counsel for himself in his absence......Basically the judge was not going to be messed about, and quite right to.

On the day there was no representation from East Kent Hospitals and needless to say the claim was dismissed, judgement for the defendant and costs awarded."

Which just shows that court papers are being used as just another link in the threaogram chain. Stand up to these bullies and they will back down.

Yet another success for Roxburghe then.

If this was me i would be going for maximum publicity, in order to get as much negative PR agaisnt east Kent Hospitals as possible.

isn't the OP on CAG (Scouse Magic) the same one who was posting on here (under a slghtly different, but related monika) a few months ago on a win against Señor Sobell?

Seems to have got more than his fair share of success against him; wonder what the formula is?
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Correct. I'm not convinced there is any particular formula here other than putting forward a reasoned defence. Sobell has form for folding/no-showing in the face defended matters.

With POFA being held up as the answer to many of the PPC's problems (were we to believe the BPA's guff on the matter) we need to monitor cases which are not fought or, like this one, where the PPC fails to show.

As has already been put forward, if the number of cases like this one increase (as I suspect they will), it will give the lie to the BPA's assertions and relegate a claim form from a PPC to nothing more than an expensive threatogram.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

And just to rub salt into the wound...

    IT IS ORDERED THAT
    1. The claim be dismissed.
    2. There be judgement for the Defendant in the sum of £235.00.
    3. The Claimant do pay the Defendant's costs of £180.00.

£415 down the drain...a lot more than the standard POPLA £27.

And where is that money coming from? Yes, from the hospital trust. So like Aintree , they are wasting NHS funds by pursuing these parking tickets. I know of at least two more East Kent cases going through the courts. What a waste of money.

Drop a line to the Public Accounts Committee. This is the kind of thing they should be looking at in their quest to reduce the waste in public sector spending.

Another question that must be asked is why did the hospital pay out good money to this bunch of clowns who didn't even bother to attend court to represent their clients? Roxburghe must be laughing all the way to the bank.

Either the hospital told them to pull out as they have now taken proper legal advice & realised that this case had no prospect of success or the solicitors didn't turn up because of incompetence & should be reported to the Solicitors Regulation Authority.

Our friend Mr Sobell has reputedly been subject of SRA attention/guidance/supervision for some time. Strangely, and coincidentally Poxburghe Roxborg, have been subject to the close attentions of the OFT and warned that their CCA licence might be revoked during the same period.

I wonder what will happen to the other two East Kent cases which are pending, one at least is being defended with help from PePiPoo? I doubt if Sobell will turn up for those.
