I'm in scotland, does that make a difference?

Yes. It's standard practice in Scotland for an offer to be tendered with a date and time by which it must be accepted. Your solicitor will guide you on this.

    seller is using estate agent.

    Makes no difference.

i thought if offer accepted it becomes a binding contract at that point and couldnt accept higher offer from someone else??? perhaps put condition in offer that property should be withdrawn from sale? after all I do need some certainity...and there are indeed other properties i could look at.

Your solicitor will expect you to be committed to this property before making an offer. Yes, you need some certainty, but so does the seller. Make an offer on the property you want to buy. If you're thinking about others, either rule them in or out, but don't make an offer on this one, only to withdraw it for no reason other than you've found another property.

It's also standard practice in Scotland for a property, once an offer is accepted, for it to be withdrawn from sale. You shouldn't need to spell this out.

Sorry, gatecrashing this thread! I came online tonight to search for this kind of thread. Our offer has been with the seller for over a week now, one party has said yes, but the other party has said no (divorcing couple ). We've been told to hang in there as "no" party solicitor is pushing for our offer to be accepted.

I am so impatient I really don't think I am cut out for this house buying business!

Evening Dimbo61, we are buying in England. The vendors are divorcing, and so far we have had one party accept our offer, but the other party is still considering, (clearly not an amicable seperation). Still no news, and I'm trying not to let it bother me, but it is!

It's not really doing us any harm in waiting, although I feel that perhaps our offer is being used as a safety net. We have been viewing other properties but my hearts not really in it as I keep hoping our offer will be accepted. Not sure whether to withdraw and just cut our losses, perhaps it's just not meant to be?! It's now been over 2 weeks.
