Sold an item on eBay 3 1/2 week ago then get email saying NAD

Basically I bought a PS3 game from tesco just before Xmas, came sealed etc and was brand new but on sale etc.....
I put it on eBay in march as it had sat on my shelf since I bought it and never played it or even took the shrink wrap off, it sold on 22/3 and was sent and delivered within the next couple of days (keep all the tracking numbers)
I then got an email today from the buyer stating "the game you sold me as brand new wasn't, the shrink wrap had been opened and the disc had marks on from use"
I sent a reply stating the above and asking what the buyer would like to resolve this situation despite the fact the picture on the listing showed it all sealed and I know it was never opened or played.
He replied with "it has defiantly been opened and used"
I resent the previous email to him and as yet haven't heard back I just wondered where I'd stand on this?
Ill happily refund his payment once I get the game back if that's what he wants my only thing is it WAS brand new and never used, who's to say he hasn't opened it now played it and finished it or whatever and now because eBay give such a long period to claim he isn't going to just claim his money back leaving me a game that is no longer brand new and potentially damaged if he's saying there is marks on the disc?

Have you checked his history to see if he bought any other games around the same time?
He could be getting mixed up with another seller/game if so.My daughters are my world0 -

His feedback and eBay username would suggest he buys and sells games for all consoles0 -
Most likely he either wants a partial refund or has finished the game and wants to send it back to get some money back0

If you have an Ebay business to protect or just making some extra money you have to grin and bear these situations and factor in any losses.
There are buyers that know how to work the system to thier advantage.
Personally I would just ask them to return the game for a refund.
Just hope the good transactions far outweigh the bad.0 -
Sounds like he's after a partial refund.
I'd stick to your guns, reply saying he must be confusing it with another item, as it was definitely sealed. Ebay will make him return it tracked, which I'm guessing he won't do.

Thanks for the replies everyone, as it stands I've still not heard anything back and not had anything from eBay about a case maybe been opened or anything maybe he was just trying his luck.0
