Help with form - employment based

Quite a way into my DRO now and whilst I've been ok knowing what I should and shouldn't be doing under the terms, aside from a Barclays bank manager calling me a bankrupt once (I do get the theory) I really need to clarify if I am considered as this catororically, after all it is not something I declare when renewing insurances

I'm trying to fill in a form in a recruitment situation for example, I am being asked this question/statement below:


Have you ever receivedor do you currently have any County Court Judgements/Individual VoluntaryArrangements/ Bankruptcy Orders/Collection Accounts registered against you,settled or unsettled? Tick Yes/No

Collection accounts - am I right in thinking this means defaults/
or accounts with debt collectors?

Apologies for this being hazy, I've no idea where to go, I'm facing a credit check which I do not want to happen but am to far in the process but at least it generates an unsuccessful letter, I do remember it being made a thing of that debt relief orders were only suitable practically if you stayed in the same employment?

  • Hi- well you are certainly not bankrupt- well done Barclays for not understanding this-hardly surprising they have had their own problems after all!!

    However-and more seriously- a DRO is a declaration of insolvency and so does have to be declared on a job application form yes.

    I am not sure how you have to declare your current situation when renewing insurances, hopefully someone will see the thread and answer that one!

  • Hmm, I beg to differ on this one - slightly.

    What is a 'collection account'? I don't know, and if you don't, then assume it does not apply.

    The question specifically asks about IVA's and BR - it mentions nothing specifically about a DRO, so you could honestly answer 'No'. (If the question had been phrased to ask about 'insolvency', then there would be no ducking it, you would have to answer 'Yes').

    Regardless of how you answer, I suspect that the credit check will be the real test.

  • HI Uptomyneckin it- I was just thinking if the employer does a credit check they may feel that the applicant was being dishonest- whilst the forms says specifically IVA or Bankruptcy, it's only because DRO's are relatively new and most HR departments haven't got their act together.

    But yes- in one sense, if it's not mentioned then you can honestly say no- hang on I'll tie myself in more knots!!!

  • Yes, I agree.

    Particularly as many in the financial industry ignorantly class any form of insolvency as bankruptcy. (The bank manager mentioned on this thread is a great example).

    Fair to say the acid test will be the credit check.
  • I'm no where further forward, still no idea what collection accounts means, form submitted with no tick either way to this particular question, just hope they do credit check first in all honesty

    OK, Collection Accounts means Bailiff enforcement
    The form came back to me and I found myself having to ask questions for my own sanity

    ***And seemingly I passed the process with a debt relief order
    I hope this helps anyone in the same situation even if this is my last ever post as everything I have ever thought has been tested I got to say!

    19/4/13 EDIT*** I ONLY PASSED IN THE EYES OF THE COMPLIENCE TEAM OF THE RECRUITMENT AGENCY, I SHOULD HAVE TICKED YES ON FORM AS I AM CLASSED BANKRUPT FOR THE EMPLOYER I APPLIED TO
