Card Fraud

Just over a month ago I noticed some transactions going out of my business account. I called up the bank and had the card stopped the day I noticed it. I called up the disputed transaction people and they credited the amount back to my account, and that they will investigate it. There was actually more transactions that the bank felt was suspicious and stopped.

Yesterday I received a letter from the bank saying that they conclude that the transactions were indeed made by myself, and that they will take the money back from me. They sent me, as evidence, a copy of the invoice written in a language I dont recognise, denoted in Euros, and other items like the delivery address, and name of the person that made purchase. None of these details were mine. I dont understand how the bank can conclude that it was me.

I will go to the branch tomorow and see what they say. Can I dispute this further with the bank, or go to the police (I have not notified the police, only the bank). I have not dealt with something like this before and dont quite know what to do. Do I just take the loss and forget about it?

    If it's not you then take it further. A police report would help your case.

    You've probably received a standard letter with the receipt copies. No need to go to the police, i'd contact the disputes team at your bank (the branch probably won't be able to help you) and let them know that these aren't your transactions. The bank have to let you see copies of what they've received, where i work we include a letter for you to return confirming they're definately fraudulent. It sounds as though they've disputed the transactions rather than treating them as fraud. You shouldn't have any problems, just let them know.

    Police will send you to the bank.

    If the Bank queried the merchant and got an invoice showing an order (overseas?) justifying the debit, then the issue is one of where were the goods sent to. If an address you use, then they will uphold the cancellation. Who is authorised to operate the account? Is it a Ltd Co, or a sole trader?

    All this makes a difference as to how they approach it.

    Lastly - how was the money 'taken' initially?

    Thanks for the quick response.

    This is a business account, I am a sole trader. I have never used the card before to make any debit card payments. I only use it at the bank branch when depositing cash in their machines. The card has never left my side, I still have it with me (cut up).

    The first transaction I noticed was for £155, made in Barcelona (online I think, I have never even been to Barcelona). This is the amount that they say was me. A week later £238 was taken out, they didnt get back to me about this yet. There were other transactions of over £2000 made at around the same time that the bank stopped. I only saw this at the bank computers, cant see them online.

    I live in London, and the delivery address by UPS was to a london address but a different part, the faxes are blurry so I cant really make out what it says, but the name is definately not mine. But the address where the card is registered is also a different address, at my business. So how can they conclude that it was me, I have no idea.

    I am the only person who has access to the account.
