Had notice from Water Utt Company

Hi,
Looking for some advice.

We moved into our lovely house a little over 12 months ago.

Today we have had a visit from Thames Water telling us that the waste from 2 en-suites run into the wrong drain. They have advised us not to worry and that they are not at this time taking things further at this time but we do need to put things right. Upon inspection it seems the previous owner has run the soil pipe to the front of the house (water run off) but this should run to the rear where the soil/waste sewer is. The annoying thing is that when you look at the drainage plans the correct sewer is closer to the current soil pipe than the one they have directed it to!

The survey we had did not show this. It took me 2 minutes and the flush of a toilet to work out the error.

Do we have any claim here?

The previous owner made many changes, these en-suites being part of those changes and on the whole the work followed Building Regs but clearly not here.

We did pay for an indemnity concerning lack of planning consent for an existing extension, can this stretch to cover the work not complying with building regs or should I go buy myself a spade.

    Lack of consent should be a warning sign that the construction is not possibly not up to the required standard.

    So buyer beware.

    If you mean a claim against your surveyor the answer is probably no, if you had the standard sort of survey which carries the usual exclusions and "warnings" to obtain extra searches/reports relating to specifics such as drainage.
