Access to my Property

Hi Everybody,

Wonder if somebody could help me please ? I purchased a house last year with my girlfriend. After buying the property it became apparent that my next door neighbour to the left was lets just say `different'. Despite offering to cut her hedge and other bits and pieces she told us she didn't want to be friendly are any friends ! Fair enough I respect everyones wishes. This is when she started getting difficult we share a joint passageway to the back of the property where we both have a path leading to the back. My path is clear to walk down she has let her edge grow all across hers in fairness it is neat but is creeping slowly across onto my path. At the end of the day it's just a path and the fact she uses it everday doesn't bother me. However at the the weekend i went to get my bike down and couldn't because of the hedge. My deeds state its a shared access so surely she should put the headge back to reveal her path ?

I have a fence on my side and an open planned driveway so if say I was having some furniture delivered it would not be a problem to deliver anything. If she had anything delivered she couldn't get it down the path like wise if I was have work down in the back I couldn't get a barrow down. I will try and put some pictures up. Just want to know if I am within my rights to go to the council and ask for full access to be possible

    I think shared access isnt that you both own 50% each i think you both own 100% if its in your way trim it with care and dispose of the rubbish . (dont throw it onto her side thats petty but been said here before )

  • Yes thanks for putting it clearer. That is exactly what I ment. If I did the same she would have no way of getting into her house or out. I could have access to the back via a gate I have at the bottom of the fence attached to my house. Believe me I have considered doing it but just feel it would be a read rag to a bull
  • I would suggest just talking to her and explaining the issue calmly and clearly and offering to help in anyway. If she really won't talk or play ball, I personally would seek legal advice. You could get this for free through your union if you're in one, or perhaps through a home insurance policy or similar - lots of stuff comes now with free legal access. Or seek advice from the Citizen's Advice Buruex or pay to speak to a solicitor who can advise. I am not sure this is a council issue unless one or both the properties are council owned? I suspect this would end up as a private legal issue.

    Try just talking to her first even though she maybe 'different' it is the cheapest and easiest option anyway before taking things further.

    Oh not not the police, I am sure they would be round in a jiffy if you brutally murdered a hedge in cold sap. People always 'chuck in' I'll call the police.
