The ICO is a toothless waste of space for one-off human error.Will the ombudsman even deal with a data protection matter? (Something not at all limited to the finance industry)
Seems the information commissioners office would be more appropriate.
The FOS will award the"victim" hard cash. Although I'd expect the bank to make a higher offer long before it gets to the FOS.0 -
Thank you for all your comments. To answer some of the queries: I share a first name same initial with the ex. My husband did have joint accounts with her but has not had for about 12years, and she is not on any of his bank accounts. They share the same bank and branch (I think she still banks with the same bank & branch). I bank with the same bank but a different branch. We dont have a joint bank account. I have chronic arthritis & have been through a bad flare-up over the past few months. Its stress like this that will cause me another flare up. I have an over draft & am within my overdraft limit but because of being ill the account has not had any money going in it since October and I think this is what caused the letter & phonecall. My husband hadnt realised that my overdraft was that much & the ex wife calling to tell him how much I was overdrawn has caused stress and now I have maritial strain. Thank you all so much for taking the time to comment, i appreciate the help in the best thing to do.0

It gets worse! So after 2hrs on the phone yesterday to try and get a comlaint logged & this issue investigated - I called again today. I was asked if I had changed my name/reverted to maiden name....to which I replied I hadn't. I found out they they have changed all my accounts into the ex-wife's name & address and also closed my complaint as being resolved!! Aghhh.....0

I find it hard to believe the bank have done all those things of their own accord. Asking you whether you changed your name/reverted to maiden name must have some sort of reason.
Hope you have now filed your complaint in writing. And asked for all answers to be confirmed in writing.0 -
Precisely. That's where the reported story just doesn't make any sense. There must be a lot more to it.
It happened to me around the time of the Santander takeover of A&L. I got a call from Santander trying to sell me new products and the salesman started talking about me having several thousands in this account and a five figure balance in that account. Very vaguely worded but I was not pleased about it and complained because then they started asking me for more information.
I thought I had been taken in by a scam but they confirmed they had called me and that it had not been done by their procedures. Another £25 resolution (which I took because strictly they had not disclosed my information).
So maybe it was a sales pitch.Few people are capable of expressing with equanimity opinions which differ from the prejudices of their social environment. Most people are incapable of forming such opinions.0 -

I agree. The OP also need to note that it is a breach of the DPA for a body that holds personal information to fail to keep it up to date. So if the OP has told them personal information intended to update their records and they have failed to do so the IC will not be best pleased.Few people are capable of expressing with equanimity opinions which differ from the prejudices of their social environment. The bank involved is Natwest....
Couldnt believe it today that they have changed my a/c's into the ex's name & address and then told me that as far as they were concerned my complaint was resolved... The poor woman on the phone, I went a bit ballistic as the situation had got worse instead of better!!
So have put all the details into writing & will see what happens. So far I have had one bank employee reaction as 'Oh my god - thats awful' and another who said 'its all a bit of a balls up' before they have transferred me to complaints dept! I think that by coming back on the phone and admitting the lack of security on the call to the ex means they know they have screwed up - will see what tomorrow brings!
