new user please be gentle

my oh is being made br by the council re business rates we have managed to get the hearing deferred once, but are wanting to get it deferred again as he is a publican and is the dps which means once bankrupt his licence gets revoked and we are out of business and home!,,,,,, any advice please!,,

    Who said his licence would get revoked if they went bankrupt?

    My mother went bankrupt from one premises and moved straight into another one and the bankruptcy caused no problems at all. She got to keep her licence. I would look into that further.

    Also speak to business debtline they will help.

    Okay sorry just looked into this again. My mum had a personal licence not a premises licence. Personal licences are not touched in bankruptcy but premises licenses are. Could he keep his personal licence and transfer the premises licence to you?

    Is this a freehold property or is there a brewery? If there is a brewery they could maybe take on the premises licence and his still runs it under his personal license.

    I'm sure there is some way around it so you don't lose your home and way of making an income.

    sorry if I am not being clear but I am not sleeping and feel sick to my stomach, yeah it's the premises licence which we are trying to put in my name ,but I have read that when oh gets made bankrupt the business gets closed and all staff sacked, and also would transferring the business to me be seen as transferring assets at undervalue aim so worried i can't think straight.....

    It would depend if its personal bankruptcy or business bankruptcy. Do you trade under a limited company and is the business rates in your OH's name or business name.

    I'm not at all clear on business bankruptcy so can't give too much information. If its personal bankruptcy then he can continue to trade as a sole trader. I have known many people that have done that.

    In my mothers case she ran a pub, got ripped off by the staff so left that pub and move into another one. Debts from the previous pub like VAT and rent were put into her bankruptcy and she continued to trade in her new pub. She was just a personal licence holder and not a premise licence holder.

    I can't see how transferring the premise licence to you would be a transfer of assets as I'm assuming he will still be the licencee and in overall charge of the business. It's not like your changing deeds to a property....or are you?

    Do you own the property freehold?

    As I said this is moving out of my area of knowledge and there may be someone here who can help you more. I really think you need to speak to the business debt people. Hope everything works out.

    I will answer the previous questions soon but at the moment I can't stop crying and feel like my world has fallen apart, I am scared of the or interview as my OH will be on his on and he is not that great at things like that can we request an face to face interview and will I be allowed to go with him, please someone help me cos i really can't cope with much more

    thank you, does the OR get annoyed if you want a face to face interview and would I be allowed to talk If I am not the bankrupt person.

    If it is a business bankruptcy they will probably insist on face to face. Mine was.

    yes it is a business bankruptcy , the council are making OH bankrupt for business rates ,,what was the OR like, that is the mostq thing I am scared of even though he has done nothing illegal these forums are scaring me .. cos we may have done things wrong without knowing the law
