Music magpie, worth taking this any further ?

I recently sent 2 boxes of items to music magpie, mostly CDs and DVDs valued by them at 30p to £1 each, knowing mm's reputation we checked each item before sending for damage etc. One DVD in particular was valued by them at £10. The total 'order' was worth £95. Of course when they got the items they rejected a few including the £10 box set and sent us a chq for £80ish. Now I know that the £10 box set was in perfect condition when it was sent to them, they cannot provide proof of the damage and just quote the Ts and Cs when I have spoken to then via the online chat facility on the website. They of course cannot return this item either, as it's been recycled, again covered by the Ts and Cs.

I just wonder wheter it's worth going down the small claims court over this, I feel that the Ts and Cs they use as a shield would be considered unfair if tested in court.
