Capital One want to charge me £12 rather than £20 per time!

Claimed for £540. Capital One want to send me a cheque for £194 stating that charges are no longer the £20 they were charging me but now £12 (so that they are more competitive?!).

So they have basically calculated the difference and offered me this.

Do they have a leg to stand on or should I continue to push for the full amount?

All advice gratefully received.

  • if they took 540 off you in charges, surely thats wat they have to pay up??
    they can't just say< that now they have reduced their charges thats all you are entitled to... Surely?? it's a minefield.

    Stick to your £540 claim if that's the amount you lost in charges. They can't change the amount now because they have reduced their charges to £12.

    Interesting. In effect they are claiming their true costs incurred are £12. Reject their offer and take them to court, where they will have to prove their costs are indeed the £12.
    They won't be able to prove this and you should win.

    I assume they're basing this on the OFT statement a while ago, although their opinion that £12 may be fair is still overruled by the law.

    My husband and I have just received the same letters. They have paid myself £32 for a claim of £266 and £320 for my husband for a claim of £950.

    Naturally, the next letter has gone out to them - lba. They have 14 days.

    This is not a fair offer in any shape or form.

    The CCC's always try to use the OFT ruling as a justification. However, even the new £12 charges (sorry, service fees!) are still "extravagantly" higher than the cost of automatically administering a late payment. The computer just adds the amount to your account - you don't even get a letter.
    The acquisition of wealth is no longer the driving force in my life. :)

    SCRAP THAT ABOVE______________________

    Today my husband got a letter stating the £322 would only be credited to his account if he signed the paper to say that wasw his complete claim. AS IF!!!!!!

    SO they lied- the money was not put on the account and others beware this is probably a new stalling tactic.........................................
