Refund help needed

Hi,

I booked a photographer on his website to do my sons firstbirthday photo shoot.

We booked this guy for our wedding and sons first shoot

We booked this 2 months ago and received a confirmatione-mail to say the day we picked and payment made.

We e-mailed him on Sunday to ask him a few questions and hereplied that he doesn’t do photo shoots on Thursdays.

He’s now refusing to give us a refund.

We booked this on his website which accepted the date we putin and the time we wanted.

Is there anything we can do?

The photographer has gone against the agreement without notifying you, he has to give you money back.

If he refuses, then threaten small claims court action.

    The bank closed?
What sort of bank did you use for it to close?

You are being too cryptic, if you want help and advice atleast tell the whole story.

When i was made bankrupt Lloyds TSB closed my account.

So i dont have a bank account with them anymore, not my choice it was theres, as most banks dont accept people who are bankrupt.

  • Have you tried talking to Lloyds TSB?

I suggest you send a letter before action threatening court and if he does not pay then sue him via MCOL (google it - very easy process).

Legally, as he's broken the contract, he owes you the money. The difficulty is getting it.

If you still had the card you paid on, the bank may have been able to help. They still may, so worth talking to them.

Otherwise it's threatening and finally taking him to the small claims court. It sounds like he may not have the money to pay you back though. Do you have any proof of what you paid and what you agreed to (contract or receipt or similar?). Might just be easier to send the heavies round :)
