or should i send the second letter. ive confused myself now......
and even stranger while back i tried for ppi hence the experian check were i first found these. and ive letters back from mint and mbna to say they have no history of these accounts ????
i have printed off both and filled in the relevant details.
just wondering should i send the prove it one first. registered post too im sure. then follow it up with the second letter registered also inc the postal orders0 -

so letters have been sent 2 weeks now and got signatures sent recorded delivery.
westcots ignored as still sending the letters threatening doorstep collector is going to call

ok. so its now 2 months since i sent the letters. none of the companies have came back to me with the information i asked for in the letters i got off this forum. i.e copies of credit agreements statements or charges or fees.
westcot have now done the opposite. rather than show me proof debts mine theyve sent a rather pushy and cheeky doorstep collecter. i refuse to give him my mobile number as i dont want to be harrased yet he only lives round the corner from me as i googled his phone number. mr williams. he refuses to listen to my protests of what i have asked for from this company. he says they will take me to court as cards in my name so my problem. its not a mistake he says. up tp me to prove its not my debt rather than card company to prove it is. i red out the letter i got from here that suggests otherwise. he says he will get the infor from card company from me quicker than i can. its 2 months now ive waited and no reply and im due to move house next week?
what do i do and is this doorstop collecter allowed to pester me like this0 -

what do i do then if this guy keeps calling to my home. without this proof surely this is harresment. should i report it to the cops or wot would anyone suggest as its really getting me down now.

2 months ago i asked for proof and they so far have failed to produce any paperwork or documents. bit long to wait is it not0 -
Did you send them a written complaint? If so, when? After 8 weeks ring the FOS.
its up to them to prove its your account, not the other way round.
I would be complaining in writing if you haven't done so already about the lack of response and harassment.
I would also report them to the OFT for breaking the guidelines on debt collection.:beer:0 -
ive sent the prove it letter to wescot 2 months ago that theyve ignored. i see its now passed to CSL credit security ltd on behalf of their client wescot / rbs. its CSL who sent the door stop collector. so i will send them also the prove it letter adding the paragraph to pass to mr willams their collector as i tried to explain to him on phone but he was rude and pushy and refused to listen, i have been ignored by wescot since sending the letter and mr williams is wrong is suggesting ive to prove the debts not mine. if he calls again i will report it as its harassment and i wont put up with it.
is that ok ?
also im told theres another letter you can send if they ignore the prove it letter. does anyone have a link to that i could print off.. i think its the one to complain ? thanks0 -

I pointed out that I have no knowledge of any such debt being owed to [The Loan Company]. I asked that no further contact be made concerning the above account unless/until you could provide evidence as to my liability for the debt in question
Despite this, you have continued to write [and phone] and make demands for payment.
I wish to complain that you have breached the following sections of the OFT's Debt Collection Guidance (2003, updated Nov 2012):

This has caused me considerable distress and I consider it appropriate that you compensate me for this.
In case you are unaware of the rules of that you are required to follow, I have been told that they are as follows:
On receipt of this complaint, which will be deemed to have occurred two working days after it was posted, you must promptly acknowledge it, in writing, and provide me with a written copy of your Complaints Procedure.
You must keep me updated with the progress of your investigation of my complaint.
Once the complaint has been investigated you must issue me with your final response, explaining your findings and including any proposal you may wish to make in order to put things right. Your final response must tell me if I may take my complaint to the Financial Ombudsman Service and how long I have to do so.
If you are unable to provide me with a response within eight weeks, you must write to me to explain why, confirm that I can then ask the Financial Ombudsman Service to consider my complaint and provide me with a copy of its leaflet.
I look forward to hearing your proposals.

You might want to give the FOS a quick call and explain the previous letters, as they may class as a complaint and they may be able to help you now if they were more than 8 weeks ago.
