Ebay Help - Item Received Was Damaged

I won something on ebay.co.uk on 10 March which I paid for immediately.
The item was in France so I expected a bit of delay anyhow I waited for the item status to change to 'dispatched' and after a few messages the seller finally told me on 30 March that they had sent the package a few days earlier.
To cut a long story short, I received the item today which they had posted on 03 April which clearly contradicts the message on 30 March which told me it was on it's way.
The item was packed ok but when I removed it I noticed some damage to the item which wasn't mentioned in the listing. I sent them a message and told them I wasn't happy to pay 80 euros for something damaged and what did they suggest. They offered a partial refund of 5 euros which I am not willing to accept so instead they have told me to return the item. I obviously don't want to be out of pocket so I will return the item to them but I am worried about the timescale involved, the original purchase date was a month ago and I've just opened a case in ebay now. I am not sure how much it's going to cost me to return the item tracked to France but I know that's what I need to do but does anyone know the timescale involved in getting a refund, if they don't receive it within so many days do they not have to refund ? I am concerned given the fact it took them so long to send it and their lack of honesty so far.

As long as its return is tracked - you will get your money back.
As a case is open - the 45 days rules as already been met.0 -

I'd state how long they took to dispatch in the dispute. I'd also put that you expect the seller to pay tracked return postage, although you cannot enforce this.

The 7 day rule is for seller protection. It does not effect the buyer.0
