Parking Eye PCN - need urgent advice please!!

    If no one on here is willing to give you a better defence - and to get a better defence you are going to have to do some work - then maybe visit pepipoo with some decent information.

    Crucially, what was the date of the "offence" if it was before October 12th, then that's one thing. If after, then it's another.

    So, first things first, date please and also, do you have all of the various letters that were sent ot you or have you followed some bad advice on here that advised binning them?
    thanks for your response, Guys Dad, unfortunately I have burned all the previous notices but the date of my 'offence' according to the latest letter was the 26th Oct :(

    Why the long face? I have already answered your query, this is NOTHING and is certainly not an 'offence'!

    Guy's Dad seemed to think you had Court papers because of the wording of your first post with 2 mentions of the word Court and a bit of a panicked post, but you don't you have just another one in the DRP letter chain and the links I gave you show you that you must STILL IGNORE THIS. Everyone ignores DRP/Zenith letters.

    Hi everyone,

    thank you all for all your help so far, hopefully you will be able to point me in the right direction now I have received County Court Claim forms. Unfortunately I have lost time as it was dated 18th June (while I was away on holiday). I am conscious of the need to respond in a timely fashion but I need to make sure I do it right. Essentially I overstayed the time limit on a car park on private land on 26th October 2012 - Please help!!!

    OK, this does sometimes happen now (a new tactic by a few PPCs, Parking Eye being one of the nastier ones currently which I am sure they will regret when they lose Supermarket car park clients*). You may have to attend a hearing (not criminal court but a less scary version, still with a judge, simply to decide the claim either way) if they push it that far - but the good news is, it's defendable.

    Start a new thread with appropriate thread title like 'PE court claim help needed please' on pepipoo here (you can see a few Court case threads on the go already so read a few first to get the gist):

    Basically your first job is to acknowledge the claim and tick the box to say you will defend in full. That gets it allocated to your local county court and buys you a bit longer to submit a defence and to see if PE actually send you their full particulars of claim if they have only sent a sketchy version so far.

    Okay don't panic with this. You need to acknowledge the claim, and say you will defend in full, also ask for extra time to draw up your defence, you should be able to that on mcol website.

    Next unless its picked up here is to register on https://www.pepipoo.com and post a new thread saying that you have had a claim from parking eye , somebody there will help you .

    Lastly is this at Aldi store you picked this fake ticket up ?

    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    In addition to going to pepipoo, just in case you don't get the help you need there, do take a look at the sticky POPPLA DECISIONS on this forum.

    Now I know this isn't POPLA, but some of the arguments in the winning appeals there will stand you in good stead in court too.

    As I said before, don't bother too much with any mitigating circumstances as if you did it, you did it.

    Instead, have a look at this barrister's letter here http://timkevan.blogspot.co.uk/2012/03/challenge-to-private-parking-charge.html

    This is the sort of challenge that could be reworked as your argument as to why you don't owe them anything. Also, points 2 & 3 of the "further information" section are pretty good too.
  • i see we all having the same problem i received a parking eye charge notice on friday for staying 11 minutes over the 2 hr notice, having to trek to the other side of bridgend town centre to bank then to different shops for school shoes for my son ,then back up to Aldi to do my shopping, which there was only 1 girl on the check out, if 2 or 3 people were serving i would have been out to my car on time, it got a photo of me driving into the car park with me and my son in it and driving out 11 minutes over the 2 hr stay, now it got £70 fine if payment is made with in 28 days, or £40 if payed with in 14 days of this notice, am abit !!!!ed really with this all this money just for 11 minutes come on, don't know if i should just the £40 on line, but after reading these post's and watching watchdog on you tube, any advise please????? Thanks
