I should imagine it will be ok, though personally I would send a PO as then you have a record and you'll be able to see whether they've cashed it. (Ithink you can anyway) Sending a £1 coin, could in their eyes "be missing in the post" and so they can then still continue to chase you for the debt IYSWIM, your CCA request would be invalid without the fee.0

just had to bite the bullet and ring CSL, the phone calls to my work have carried on, and I can't let that happen, the calls have been going to my bosses desk, it is only that he is away on business for a few weeks that he hasn't answered the phone, he is back tommorow so wanted the number off their records.
they told me that they do not think that the number of calls i have recieved is acceptable, and that I do not think that they should be speaking to my work collegues, they said they are deffinatly not doing anything wrong and are not in breach of the DPA
I have been told that i have to either pay off the total debt or 10% a month neither of which I can do, or a charge will be placed on my property, i'm not sure what this means but it can't be good, and I will be visited by doorstep collectors, again which I know is not good.
I'm worried sick, can't concentrate on work and can't tell the wife as she is having enough problems with our 5mth old daughter who isn't well.

Could you not intercept your boss and say something along the lines of,
'I have been contacted by a company who have mistaken me for someone else, they are harrassing me and have managed to get hold of all my personal numbers, I'm in the process of getting them off my case biut in the meantime if they contact you please can you just ask them to send all communication via letter to myself.
I need this to build up a case against them of harrassment.'
I know it's stretching the truth a little but it may head them off and maybe your boss or admin can divert/cut off calls from them. Good luck.DFW Nerd 267. DEBT FREE 11.06.08

They can't do this without a CCJ, which I presume they haven't got. I think misrepresenting the law is another point on those Debt Collection Guidelines referred to earlier.
Doorstep collectors in 99% of threatened cases do not call and don't have any rights anyway. Bailiffs can only be instructed if you default on a CCJ.
Along with all the other bodies you can complain to, check if they are a member of the Credit Services Association, and if so, complain to them too.0 -
I would make one minor change to your letter. My suggestion in green.And finally I would also like it noted that I am in discussions with regards my position following a breach of the Data Protection Act by yourselves, where on 15th may 2007 at around 11am you discussed matters of my dealings with yourself with a 3rd party who is not privy to these facts. This call answered by a colleague of mine has served to greatly embarrass me and may also effect my position within my company with regards future promotions and pay increases. Without any permission from me you informed my colleague who you were, and disclosed my personal reference number. As I mentioned previously I am taking advice with regards my position and will be in touch in due course to discuss this matter further. In the mean time I would be grateful if you would send me a copy of your complaints procedure.
As you are aware I require a response to section A of my letter within 12 days, this is a legal requirement, I would also appreciate a reply with regards section B & C to the same time scale, before I take further actions"

could someone explain what they mean when they say they are going to place a charge on my property, is it the same as securing the loan on the property so if i can't pay they can take the house?

A charging order more or less means that they place an order on your property and if you ever sell it they cn make a claim for repayment after your mortgage has been paid off. Please do not listen to them, these are just scare tactics and they are trying to bully you into paying them what they want. They cant get a charging order without going to court and a Judge will see that you have tried to make payments within your means and will more than likely through them out of court.
I would give The National Debtline a call just to put your mind at rest, if you speak to them or look at their website you will see just what they can and cant do

they are at it again,
more calls this time to my wife who calmy stated that we have spoken to them before and require all communications by letter, which they again said wasn't possible as they are only a call centre (so obviously have no computers or anyone with the required skill to write a letter, appologies to those that do work in call centres, youe not all bad) when they gave her my ref number she asked if they should be giving out that number to someone they didn't know, they responded that it was their ref number so it didn't matter
and at 7:15 last night, a time which i told them is not acceptable, but they said was, i recieved a call from them saying the usaual stuff, may be recorded blah blah etc.... then he said that he was putting me through to one of there accountants, he then put me on hold, after 5 mins i got bored, and put the phone down, hung up an hour later so don't know if i was put through to anyone.
anyway, starting to get really miffed now, not had a response to my letter mentioned earlier in this thread but wasn't expecting one yet, they do have 12 days to reply but is there anything i can do in the meantime to make their life difficult?
i think i read somewhere about charging them for my time when writing letters and answering their calls, is this possible or did i eat some cheese too close to bedtime? and how do I go about recording their calls, if i tell them that what they say is being recorded they may be a little nicer to me and at the very least i will have a true copy of what they said, my brain is like a sieve, especcially when i'm wound up.

DON'T SPEAK TO THEM BY PHONE! Don't confirm your name, don't say you've got the wrong number, just put the phone down as soon as they ring. Definitely don't wait on the line for 5 minutes at their pleasure. You are letting them control the situation, which is the wrong way round - you are the one that controls whether they get any money and they are the ones trying to get it off you, therefore you are the one with the power in this relationship and you are the one that calls the shots. They can't respond in writing to you? Well that's their tough luck really isn't it, it's definitely not your problem.
Sadly, the easiest way to stop the calls is to change your number, BT will do this for free.0 -

As per my previous post, they can not refuse to comply with this request as it is set down in black and white by the OFT.
You have already written to them requesting this - you now need to make this a formal complaint to CSL, in writing quoting the guidelines saying that they have not adhered to your request to remove all contact telephone numbers from their data base.
You also need now to record the times and where they are calling you. Advise CSL you are keeping this log and that you will be using it as evidence if you need to make a compalint to the OFT.I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!0
