Trust Deed fail what happens now?

My trust deed is going to fail, they have agreed that due to changes in my circumstances beyond my control that I can no longer afford to make payments, I haven't paid since October last year.
I have heard nothing from them since they agreed this about a month ago.
I qualify for a LILA which I will apply for, but I understand that I need to be discharged from the trust deed first, is this correct?
