    By claims handlers applying discretion like this, you aren't really treating customers fairly. TCF should be applying the policy wording consistently and amending it where necessary.

    That is a fair point - and presumably something which gets brought up in underwriting meetings (I only have slight involvement with that, so I can't comment). Policy wording is reviewed on a regular basis.

    We've certainly amended policies which we have control over (our open market wording doesn't have an exclusion like this), but on panel policies, the wording is generally down to the intermediary - Saga, AA, Marks and Spencers etc will all decide on the wording.

    It may not be TCF in the sense that you'll get a different result depending on the underwriter that you are placed with, but we have no control over how other panel underwriters deal with claims, and only limited control over the precise policy wording.

    If the insurance company have turned you down and the police are investigating have you tried a claim against the council who provided the carers?
