Do you think I will get my Deposit back?

We are moving out of our rental property next weekend. I am confident that everything in the house is as it was or better than when we moved in with the exception of the kitchen floor.

The day we moved in we caught the bottom of the fridge freezer in the lino in the kitchen because it wasn't flat on the floor (later found out that it was because the kitchen flooded and the lino wasn't replaced. As there was another rip in the lino elsewhere within the kitchen that the landlord tried to cover up we agreed that we would replace and halve the cost with the landlord.

A couple of months later she decided that she wanted tiles laying on the kitchen floor so said if she bought the tiles and we would get them fitted. Anyway my husband fitted the tiles using standard spacers etc from Wickes and once he got 3/4 of the way through the kitchen diner we ran out of tiles. 3 times we requested the landlord to purchase tiles so the job could be completed but she didn't and now the floor is still not complete.

Also the tiles run through from the hallway which were fitted prior to us moving in. The standard spacers my husband has used in the kitchen means there is a difference in the grout lines (I think they used matchsticks in the hallway and we used standard spacers in the kitchen)

I am now worried that she might withhold deposit because the kitchen floor is not complete. We don't have any written evidence of requesting the tiles as she only lives 4 doors away.

What do you think our chances are of getting our full deposit back?

    If she provided the tiles and there were not enough, then you are not to blame.

    Assuming the property is in England/Wales, has your deposit been protected and have you been given the full information from the deposit schele she used?

    Yes I have all of those details so am confident the deposit is protected.

    I suppose my worry comes from not having anything in writing, even the agreement that she would provide the tiles, she hasn't been the best landlord (10 days after moving in had to tell her to stop "popping" round as we felt we weren't being allowed quiet enjoyment in the property) so I just think she might look for anything to withhold the deposit

    If she does attempt to withhold the deposit, then raise a dispute through the relevant deposit protection scheme.

    You say you're confident deposit is protected, are you certain, have you checked with the dps it is definitely there or with any other scheme provider? Do that first.

    Thanks for replies. Yes I have had a letter from DPS with reference number on so am sure we have the deposit protected
