TBF nobody has actually said that though. OP has asked the question because he didn't realise that it was standard practice, and all of the responses so far have simply confirmed this.
Thanks for the support. Yes, I am not saying the practice is wrong, I run a business so I can support them charging. I just wasn't sure it was standard practice.

My daughter's nursery is open for 48 weeks a year with closures at Christmas, Easter and two weeks in August. If we choose to take our own holidays outside of those weeks then we still have to pay. I think we also pay for bank holidays and snow days.
My son's childminder does not charge for her own holidays. I have a termtime only contract with her and if he doesn't go then I still pay.0
