HSBC and Westcott Credit Services

I had my house repossessed in late 2007 which was finally sold in early 2009, however with a shortfall. This debt was passed from HSBC to Westcott Credit Services whom i have been paying each month since. However i have a couple of issues:
1 They don't/haven't/won't send me any paperwork regarding the debt
2 My experian report suggests i am not paying any debt off, both Westcott and HSBC say that the other is responsible for updating this.
Any suggestions gratefully received..

Stop paying until Wetcloth come up with anything.
Look at it this way - if I sent you a letter saying you owed me £12,000 would you pay it if I made the letter all colourful?
Send WetCloth the "prove it" letter. A CCA request wont be worth it as a mortgage isnt under a CCA.
A SAR would be, but that would cost £10.
i'd also be wanting to know why it took them two years to sell it? What figures were used to get its value? Do you have copies of all of this?0 -
Formal complaint to Westcott. When HSBC sold the debt, they are required to agree between them who will update your credit report.
No joy, refer to FOS.
Also ask for proof Westcott own the debt. They should have a notice of assignment.
I would also not pay until they send you proof and a statement, which is a reasonable request under OFT debt collection guidelines. Any charges added should also be reasonable, so adding random charges for random amounts is not considered reasonable.:beer:0 -
can anyone help ? i am being harassed by westcott by letter and also another company polonis. long story short is i had a mint card from 2002. in 2009 i had a few grand on it. this was to be put against an iva that my then wife arranged along with another 50k debt she got herself into. she was to pay back £200 per mth for 60 payments. we spilt in 2010 as she wanted her own ways. ive been fighting since them to see my two kids and the split was very bitter. i continued to pay for the house for them which theyve since left and now lies empty an i cant sell. it will probably go next as i am into my 4th month of arrears. i was forced from the home legally 3 years ago and allowed no contact with wife. this has all now eased and ive been seeing my girls once a week.
anyhow.
due to ppi adverts i got an experian check done. i found 2 amounts for credit cards mint for 8k and this polonis ive never heard of for 7k. in my name. the iva has ended as she stopped paying it in 2010 some time after we split so the company harrington brookes i think have handed the debt back. now westcott is demanding 8k for a mint card i dont know about or how its that amount. i dont think i used it since 2008 she must have up til the iva date or used credit card cheques. the other i have never even heard off... i am at my wits end with the house i will propably be taken to court for its on at 150k with 148k owed........
these 2 cards however scare me. yes i had a mint card long time ago 2002 account since and i never had anywere near 7k on it infact hadnt used it or renewed it as far as i know since arounf 2008........
do i ignore these letters as they are old debts..... ive already tried wrtiting to mint asking for when and were card was used as possible fraud by ex wife... they arnt intrested. westcott are now hounding me with red letters and the other polonis are sending stuff to my mothers address. i am due to move soon and want this to stop. i was shocked to see 15k of debt in my name on experian. can anyone advise0 -
