Great reading this cos tody I got a letter from Nationwide saying that they are goin to defend my charges claim and has given the name of the acting solcitor. So I suppose that means bye bye to my reclaim (with the luck Ive had the last six months's I'm not surprised).
So do I carry on and fill in the next part what the court sends when they file their defence or call it quits now ??? their expiry date is the end of this month.0 -
I don't think it will be the end of reclaiming charges. He can always appeal.
Typical of corse that the bank/solicitors didn't turn up at court though.

The Judge did say that the Claimant would be allowed to appeal against the decision so I wouldn't be suprised if it was overturned.
I reckon that the judge will overturn the judgement after he realises that charges are disproportionate to the charge held by the bank. Also your forced into the terms and conditions as every bank has roughly the same charges and if you don't sign with a bank you don't get an account.
Ozzymodo - I would carry on defending your case - who knows - it may overturn the judgement.
Remember that Barrister who is taking the bank to court - he may change the whole precedent of bank charges in favour of the public. :T :T :T0 -

This is a District Court decision and is not binding on other courts.Not even wrong0

That's a valid point actually - it's only if the judgement was in a high court that there would be problems.0

It is not valid for any other case as it isn't a High Court ruling. Judge Mackie at the Mercantile was interviewed the other day and said unless there is a test case it won't be sorted and he didn't think this would happen.
Keep claiming them back. This is just one case where a Judge didn't understand the case."Stay Wonky":D

All the banks/credit cards etc are issuing a defence. It just means they are following the process. Just carry on. You will get the money back when you get a court date and then lodge your bundle. Until then, just follow the process step by step."Stay Wonky":D

my case with Ltsb was the first case to get transferrred to the mercantile court in the country. ( with Ltsb I mean not in general) and they chose to pay out instead of attending.
that would have been legally binding AGES ago- but still they chose not to turn up. I for one cant think of why:beer: Well aint funny how its the little things in life that mean the most? Not where you live, the car you drive or the price tag on your clothes.
