Thanks Stroma. It actually occured in Scotland, so I dont know if the law differs here from England and Wales?
Wait on. POPLA? 35 days from PPN applies in England, but is it same in Scotland or can PPC actually say 35 days from this letter? And they have said working days.
Need to check out Scottish regs here, although being Members of the BPA, they have agreed tho follow their COP.0 -

Chances are your appeal might be upheld (= allowed!) anyway if it's already close to 35 days since they would have received your appeal. Britannia are VERY TAME, do allow some appeals and do NOT use small claims Court - it's only a case of ignoring a few letters even if you hadn't appealed. Easy to ignore, I did.
He did watch the clip and I told him the comparison to the Nigerian Prince type emails, hopefully now he will get the message that these private parking fines are similar scams. One of our friends, who is a head teacher got a fine at Christmas, but didnt pay it as the notice had blown off so had no idea she was "liable", she got a further letter demanding £60 and paid it! It just shows that even professional, educated people like that are caught out. Why are the parking companies allowed to do this?0 -
Why they are allowed ? Because its a very grey area and things have never really been tested in a higher court, we've had vcs -v- hmrc which is a higher tax tribunal case, and that was binding on lower courts. But that wasn't specifically on this.
Parking companies would never willingly appeal any decision that would threaten their money making scam, if a case was ever heard the judgement was that this whole thing was illegal the whole house of cards will fall.
That is another reason why there are hardly any small claim court cases, to many failing because of spurious claims and companies could be banned from making any small claims completely. If that ever happened it would reverberate in the whole nefarious industry.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Very interesting reply Stroma, it just got me wondering why people just dont park in these car parks and not pay the entrance fee/ticket? Whats the worst that could happen? They get a parking charge notice that they ignore and no legal action could be taken, or am I simplifying things too much?0

Legal action can always be taken, there is nothing stopping people and companies making a claim, whether its legitimate is another question. But in regards to paying for parking, if people never paid in p&d car parks they wouldn't exist very long as what would be the point of leaving them open ?
We on here would never condone non payment of a legitimate and fair charge whether its a private car park or council. There is a huge difference for a fee to park, and a dressed up penalty for a so called breach of contract.When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. A PPC might say so to try to scam you - but who cares, it's only a matter of ignoring their junk mail like everyone here has done for many years! We wouldn't tell you to do anything we had not done ourselves. Britannia are not going to break the habit of a lifetime and suddenly chase their first ever small claim - and choose you in Scotland when they are based on the South Coast of England!
