Over stay parking charge at ASDA Bedmister...DO I PAY OR IGNORE??

    mate, just park there , get the bus to town for the day and then pick the car up later.....you may even get your car washed with an i.o.u on the windscreen or even a rubber wheel clamp :eek:
    I'm probably the last person to defend 'not so smart parking' but it's behaviour like this that forces the Supermarkets, Asda in this instance, to impose some sort of control.

    In this sort of situation properly controlling the parking would be better done with a barrier & a ticket endorsed at the Asda checkout. Alternatively when planning permission is granted they should insist that free parking is provided for all as a civic duty to defray the negative effect that their superstore will have on other retail outlets.
  • just an update.....i have now recieved a letter , demanding the money or they will take me to court.

    NOTICE OF INTENDED LITIGATION

    reads......if you are avoiding making payment we will recommend to the landholder that they commence county court proceedings...

    now then, does that mean that ASDA will be taking me to court as that they are the landholders?

    also reads.....please note that if the case reaches court and a county court judgment is obtained, the amount will increase and your credit rating may be affected.
    the parking charge was issued on private land in accordance with the protection of freedoms act 2012.

    So then...is this still a load of bull?

    its just that every letter i am getting states that i was parked in breach of the agreed terms an conditions.....dont say what i have done tho

    Continue as before but make a firm complaint to store manager(if not done so already) you were only shopping there so its up to them to cancel.

    The key word here is "recommend". It's unlikely the land owner would agree to the recommendation given the negative publicity that it would attract for taking someone to court for, er, spending money in their shop.

    Agreed. Most of the free supermarket car parks seem to have a "No Return within x hrs" as well as an "x hours maximum stay". It would be terrible publicity to be seen to fine a customer for popping back for a bottle of milk that they had forgotten with their weekly shop an hour earlier.

    Highly unlikely Asda will take you to court - they wouldn't want the negative publicity. Just another empty threat from PPC scammers. Even if they did try it on, they could only obtain the actual losses once they'd proven a contract existed. Their losses are zero as you bought something, and good luck to them trying to prove the contract!

  • Hi, I have received a letter from the above company and it does not outline why the Parking Charge was issued yet on the reverse side it states "The Parking Charge has been issued for the reasons explained overleaf, therefore giving reasonable cause for Smart Parking Ltd to apply to the DVLA for the details of the registered keeper"

    The time and date is stated but not the reason ?

    I thought the "facts of the case" had to be described in the document ?

    Has anyone any thoughts on this ?

    Welcome to MSE.

    It's a 'Notice to Owner' following a windscreen ticket isn't it? I have seen one of those and it was easy as pie to appeal and get cancelled within days.

    Not only should they NOT call it a NTO (should be Notice to Keeper) but you are correct, Smart Parking miss off the contravention on these NTOs which follow a windscreen PCN = a non-compliant notice on two counts.

    Appeal it online telling them you've sussed these flaws and there was no loss caused by the driver's parking either, and it will be cancelled I suspect.
