Another gym thread

The gym I use has recently been bought out, closed for a few days and re-opened.

They were pushing people to sign up before it reopened, so I did, thinking it'd just be the name above the door changing.

Wrong.

I've been this morning for 5 minutes. The equipment has been replaced with filthy old equipment they've obviously bought from some other gym that's either gone under or is doing a refurb. There is chewing gum embedded in some of the machines and they feel cheap and flimsy.

I would normally check a place out before joining, but because they didn't have that option at the time, do I have any recourse legally to cancel my contract? Only around 1/4 of the place is usable - the rest is taped off or all of the equipment has been removed. When I asked the staff, they just said it'd be opened up 'soon' and couldn't give even a rough guess as to when 'soon' is.

I have emailed the general manager to ask if I can pay for my trip today at whatever their single visit charge is and cancel my contract as I do not feel confident working out there with such dirty equipment

    Maybe you'd be happy paying your subscription once they're fully 'open'? Sounds like a bit of a shoddy start to being your new gym in the area though

    the other thing being is that when they were touting for business under the previous ownership, i was advised in there that the equipment would be staying the same (pretty decent quality) and it was just the name above the door changing. even the website shows all of the previous gear and makes no reference to doing the place over.

    i've emailed the GM and called their parent company to cancel, but they need to speak to the general manager at the gym to authorise it

    Screen shot the website. Do you have any other sales literature stating this?

    I'd be looking to cancel based on the fact they've misrepresented the service.

    Or if 3/4 of the gym is not accessible at you was reasonably made aware it would be, then keep a copy of your complaint, if not resolved consider this to be a breach of contract instead and cancel.

    Getting them to accept this though may be another matter.

    How have you paid? If DD, then i'd be tempted to cancel it leaving payment for the current month only.
