Gym membership wont refund help

On the 2/4/13 i went to my local gym and paid £100 for a years membership in cash, i was told what equipment was available etc.

Today 3/4/13 i went to the gym to train and was disapointed.
There were hardly any free weights and some machines were out of order, i just generally didnt like the place, seemed to be a lack of equipment in regards to what i was told.

I went to the reception and was told by a manager no refunds allowed. However if i had paid monthly by direct debit i could cancel within 14 days.

I have not signed any contract nor made aware of any T&Cs etc. I simply paid my money on the strength of what i was told and have a receipt

So am i within my rights to demand a full refund, if so on what grounds? im assuming i could claim to have been miss sold? or is there other laws regarding these type of purchases?

If anyone can advise, i would be gratefull. adam

    Why didn't you check the facilities you were paying money for? You paid for the annual membership (£100 for a year gym is very low btw, that would ring alarm bells with me) and then 24 hours later you are unhappy.

    This is more like buyers remorse to me, you cannot claim under DSR so you have to prove that what they told you (and hearsay is not a valid complaint in court) doesn't meet with what they offer. Without anything in writing you are up against it.

    A contract can be verbal, it does not need to be written.

    I didnt check because i was trusting and got duped. The sales guy was very busy and basically rushed me through when i went, fill in this form, £100 for year or £10 month special offer (usually £15 month)

    Not disputing the fact i should have checked and was naive i was just hoping i would be protected from such practices.

    Not buyers remorse, the gym was not what i was expecting from what i was told.

    So i cant just tell the court that i would have to prove it?

    Surely the gym would have to prove otherwise?

    I dont know lol, probably just suck it up for the sake of 100 quid then.

  • If the gyms equipment is constantly out of order you might have a case, but just because they were out of order on this one occasion doesnt meen anything. If you do decide to visit and the equipment is still faulty(take pictures) for longer period of time you could complain.
  • yeah, wasnt so much that tbh just the lack of free weights equipment, i was told "yeah mate plenty of gear"

    Got to the gym and i could find literally no free weights to put on the barbell lol.

    Yes there were free weights just not enough, i was told "well its peak time"

    surely the gym should cater for peak time.....

    Would have thought if there is not enough equipment available the service i am paying for is unavailable.

    But court seems a bit of a pain in the !!! for £100 at the end of the day

    you have paid about £8 a month, many gym memberships are over £50 a month.

    you will always have peak time in any gym, if you join a gym with a membership fee of £8 a month it stands to reason they will be busier than one charging £50 a month.

    you have been there one day. you probably need to give it more time, or avoid off peak if crowds are the issue.
  • I know its cheap. I only joined to save a few quid the gym i have just left was only 15 a month much cleaner, more equipment etc.

    But thanks if Theres nothing i can do i will it up and see how it goes for a bit.
