Credit card dispute

I purchased a car on my credit card and before I left the dealership it developed a major fault. I was then sent home in a courtesy car (an old banger that had no petrol) and was told the car I had purchased would be delivered the next day and they would pick the courtesy car up.

They never delivered the car and didn't even call so then I decided I wanted to pull out of the transaction and told them this then, which was 24 hours after I had purchased the car but not taken it from the dealership. This was over 3 weeks ago and as I have no insurance on the courtesy car I sent the keys back and told them to collect the car.

Capital One have said they wont get to my dispute until the 25th April (i told them about it on the 9th march) so I'm just worried, is there any chance of me losing this dispute? How much clout do the card companies have in disputes?

I called trading standards and have done everything they told me to do so far.

    Wait for a better advice, but I am sure that C1 just fobbed you off.

    I would send them a letter before action, then submitted a claim in a small claims court (online). Don't know if a claim can be against both C1 and garage or it has to be either of them.

    Thanks grumbler, I have sent them a letter already and followed advice from trading standards.

    As for the dealership they keep going round in circles. It's honestly hard to describe other than its like their minds get wiped after every call I have with them. For example, i will call them, explain that I have sent them the courtesy car keys because I am no longer insured and they agree to give me a refund and they will send someone to pick the courtesy car up, they end the call with a request for me to call them back on Monday. I do that, then its back to square one, they say I have to bring the courtesy car back to them to get the refund.

    I'm not sure if they are just really really badly organised or they are trying to con me.

    Is it possible for a courtesy car to be insured for any driver?

    Is it a Visa card?

    Not sure where the yahve got their timescales on this. As there is a clear faulty goods issue here. Thankfully you never left the garage.
    Should have been able to action c/b after 15 days.

    Time frame is not a issue (120 days) never mind the 6 years CCA side.

    Clout wise plenty so long as you have a good case.
