Ukcps fine

Some advice would be greatly appreciated

Ukcps put a sign on my car after being in retail park this pm claiming I was parked outside the marked bay(not sure if was but it will only be just a little as the entire row was empty)
Realise now I should have ignored but in a fury wrote letter demanding they produce evidence for this ridiculous fine but obviously confirming I was driver and my address etc
What should I expect now and what should I do, just ignore despite threats or have I already admitted liability by writing to them and asking for evidence which they presumably have ?

    I say once you have appealed you may as well do a strong challenge to POPLA once the PPC reject your letter and send you a POPLA code (if in England/Wales).

    UKCPS have form for not giving POPLA codes within 35 days of receiving a challenge, so wait and see whather they do or not. Do not prompt them for the code, just wait and let 35 days elapse from when they would have received your appeal.

    You did the right thing IMHO and to ignore them AFTER appealing is pointless when POPLA is there and if they don't give you the code then they are stuffed.

    HTH, never mind about their 'evidence' just wait for them to fail to give you a POPLA code. And DO NOT reply to any pm's from new posters about this scam, offering to help you. UKCPS have been known to post here and pm people on occasion. Do not reply to pm's and do not name the retail park here either.

    Hi Guys

    I have had a 'Parking Charge Notice' from these clowns for parking outside a bay. Is it still best just to ignore them?? What if your car was leased (eg not the registered keeper?)

    Also, on the 'ticket' they have completely misspelled the location so technically I wasnt at where they have suggested...

    If it's leased, the best advice is to appeal giving your details, then ignore everything they send you.
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    So just an email to the appeals team saying I received ticket on my car but it is leased????

    NOOOOOOOOO! Don't tell them it's a lease car! ('Appeals team', LOL, they seem to work out of a caravan at the back of a Pub in Leeds!*).

    I say just challenge the legality of the ticket, along these lines, without giving them any info but just calling it 'my car':

    Read the whole discussion including the input from Broadsword who has experience of advising people about certain appeals - and Broadsword has some clout!

    Then see if UKCPS send you a POPLA appeal code (England/Wales incidents only) with the rejection, but do NOT prompt them nor tip them off about it being a lease car which might tempt them to write to the lease co. (not allowed if you've said you were driving, but this is UKCPS we are discussing here).

    You need to write IMMEDIATELY to hook UKCPS in your direction because after 28 days they can start harassing the lease co. if they don't yet know who was driving (and lease companies routinely stupidly pay these fake PCNs then charge the driver plus a hefty admin fee on top!).

    Start your own thread please once you get that rejection letter, having hooked them into replying only to you.

    After sending a letter UKCPS have written back saying they will not enter discussion about the legality of parking on private property but on this case as a goodwill gesture have dropped the charges.

    Maybe they are getting the message, maybe I got lucky ??

    Well done! Haswell the head tea-boy at UKCPS may be running scared of POPLA and concentrating instead on 'ignorers' as easier 'prey'. Must be to do with the re-shuffle in the Leeds caravans at the back of the pub, now they have a shiny new 'Service Realisation Dept' (my 'sauces' tell me that they really have got such a Dept!). :rotfl:

    This cancellation is rather like the current approach of Parking Eye, concentrating on the weaker cases. Because if a person doesn't appeal in time then they can't use POPLA at all and to an extent are then at the mercy of the PPCs' chosen bombardment of whatever threatograms they favour, plus phone calls and similar irritating and intimidating harassment.

    Also the PPC could theoretically try to 'paint a picture of unreasonable behaviour' for a judge, saying that, as well as the alleged 'contravention' there then followed 'unreasonable ignoring' of PPC letters which included an offer of POPLA. ''And we are AOS members...and we play nicely and have pretty signs, cameras, hi-vis jackets and all, m'lud. We even offered a discount but norty motorist never replied so what else could we do but this claim...''

    So I think your case shows that our current advice is right. :)

    Challenge the legality of the thing and then - if still rejected - use POPLA (worded as a VERY strong appeal with forum help) to see off any PPC in England And Wales, as long as you've checked they aren't a non-AOS member and even if they are, they are not currently banned by the DVLA (= ignore of course).
