Returns issue with Amazon

Hello all!

I purchased a tablet computer via Amazon late November last year as a Christmas gift, which became defective about 2 weeks after Christmas. I contacted the seller via Amazon to report this and they advised me to return the tablet in the post with the promise that a replacement would be sent back.

After about 2 weeks, no replacement so I contacted the seller to ask where it was, they told me there was an issue with the post and another was on it's way....... it didn't find it's way however. So again I contacted them and they gave me the same spiel. I tried one last time with the threat of reporting to Amazon, and I heard nothing back.

Amazon have refused to help me here let alone refund me as I hadn't contacted the seller within 14 days as per the T&Cs.

So I'm stuck. I fear that I may be out of pocket here, which outrages me as I had faithfully purchased the product via Amazon, and they seem powerless to help. Is there anything anyone could recommend?

I should add that I had paid for the product using my credit card and it was over £100. I have heard that they may offer some form of protection.

Regards,

Brendan

Yes, read MSE's article on Section 75 Refunds and contact your card issuer.

Is buying through Amazon Marketplace not the same as buying through Paypal as far as S75 is concerned ?

I wouldn't have thought so, since unlike Paypal, you can't "fund" your Amazon account - you can only make payment for the purposes of buying something, and your Amazon receipt is clear that you paid for the goods using card. With Paypal, your receipt will say that you paid by Paypal, which is where you start to have problems.
