private parking in university HELPP!!

HELP!!

hi,

i need some advice guys, basically i had a cousin come from pakistan for a visit and he has been using my car to visit hes friends at the university and he has been receiving various parking tickets that i did not know about untill i got letters through my door couple of weeks ago demanding a sum of money from a company called "Carparking Partnership" which is a private parking company.

now i dont know what to do... he did not know what they were because he is foreign so im guessing he just threw them away without telling me and he has been doing that for the past 2 months so god knows how many times he received the tickets. now he has gone back to his country.

any advice guys? or should i just write them a letter saying that someone else has been using my car and give them his address in pakistan and tell them to send the tickets to him?

on the letters it has i have to provide them with the address and name of the person under section 4 of the Protection of Freedoms Act 2012. does anyone know of this act?

PLEASE HELP! more information can be provided!

    Oh you lucky person.

    You give the name of your cousin as the driver and his address.

    You are then off the hook, as long as when he gets the letters he admits it was him driving.

    There is no need to write them a letter. What they have sent you is a Notice To Keeper inviting you to name the driver & give his address. Normally that is sufficient to discharge your responsibility. However the act requires a the name of the driver & a "current address for service for the driver" which may be interpreted as an address in England or Wales where a court summons could be issued.
  • okay but he lived with my and my uncle and he doesnt have a "current address for service for the driver" so im guessing i just give my address?

    do you guys think that this matter will lead to a court case?

    I would imagine that you should provide his proper address in Pakistan then it is up to the PPC to chase him. I only questioned the fact that it needed to be an address in England or Wales. On reflection I don't think that matters nor does the fact that they cannot issue a court summons to someone who doesn't have an address in England or Wales. Provided that you have named the driver & given his address then you have discharged your duty & the PPC cannot chase you for unpaid charges. It's a similar situation to if he had been driving your car & got a speeding ticket when flashed by a traffic camera. The onus is just on you to name the driver. The interesting point is that the law has nothing to say about what happens if whoever you name denies being the driver.

    I would do this exactly, state all the ticket numbers in a heading and add 'plus this response also covers any other CPP tickets alleged as incurred between xx date and xx date at universities' even if you give your address 'for service' but also make it clear in your single letter that the driver actually lives in Pakistan. NO WORRIES!

    You only have to give the driver's name and 'an address for service' then the owner/keeper of the car is out of the equation completely and can't be named in any Court case. Can I just check, was this all in England or Wales (not Scotland, where the advice would be different?).

    As the registered keeper of the car, you simply need to reply (stating that the reply applies to ALL tickets that CPP may allege have been issued against that vehicle).

    Just say who was driving, you ONLY have to give 'a name' and 'an address for service'. I would add in your short letter, that the person in fact lives in Pakistan so the address for service is only given as your address to comply with the Protection of Freedoms Act and that the person will not be responding.

    However, you know that you - as registered keeper - now have zero liability under the POF Act so they MUST NOT write to you again or you will report them to the BPA and DVLA immediately.

    You do not need to add anything else. It's NOT A FINE.
