When can I give sole agency notice?

Hi,
Our house is up for sale with a local estate agent. Their terms say...
"The sole agency will be for an initial period of 12 weeks, but then may be terminated by either party giving 14 days written notice."
This is signed and dated 11 weeks ago.
We want to move to a different agent, just to see if they can do anything the current ones aren't doing.
Do we have to wait until the 12 weeks are up to then give 14 days notice? I.e. we are actually tied in for 14 weeks?
Or can we give notice now, so that it ends in 14 days time from now which is past the 12 weeks?

No. Give written notice now. The contract will end 14 days after you serve notice.
Note 'serve' = when they receive your letter, not when you post it.0 -
IMHO, you can give them notice now, but you still have the 12 week minimum, and the 14 day notice period thereafter, with the contract ending after the 14th week.0

FWIW I think G_M is correct.
On another point though, do make sure to get a written list from them of all potential buyers they believe they have introduced and give it to your new agents. That should avoid you being chased for two agents fees if one of those buyers does buy it.0 -
Just spoken to the agent. Haven't quite got an answer to the question, but he said he'd accept notice today because he doesn't want us saying bad things about him!
