Faulty TV - Can I ask for a replacement/repair?

Hi,

I bought a plasma TV July 2011 for £600 (not a sale or end of line item) and over the weekend it has developed a fault. Great I thought just a few months past the 1 year warranty. But speaking to my father in law he said that this would still be covered by consumer rights as not fit for purpose as items such as TVs and are covered for 6 years under the sale of good act.

He gave me some bumff on it and looks like he is correct but just wanted to know if anyone else has any information/tips for me before I go and have a chat to the retailer.

    He's wrong, you have upto 6 years if you can prove the fault was inherent, it doesn't mean every item has to last 6 years.

    Phone/chat with the retailer and see what they will offer if they want you to pay for a report then that's what you have to do, or phone the manufacturer to see if there's anything they'll do.


    Also, if you mean July 2011 you've more than just a few months out, more like 8 months.

    Who was the retailer? Some are easy to deal with, others not so much.

    They are within their rights to ask you to get an independent engineers report done. If this comes back the tv having a manufacturing defect then the retailer has to provide a remedy (repair/replacement/refund- which can be partial) they also have to reimburse the cost of the report.

    If it comes back as not being a manufacturing problem then it's basically tough luck and they don't have to do anything for you.

    That's not what I'm saying at all, I'm saying that I would expect a TV to last more than 19 months of what I'd say average use. What would you say a reasonble amout of time is for a New TV?

Yet all goods must also last a 'reasonable time', this can a long time for some expensive ones. Full info below on comsumer rights. "
  • Got the TV from Richer Sounds who have a pretty good rep from the people I've known to of used them.

    I'm fine with getting a repair report I'm just miffed that a TV can go wrong within such a short time its not like a TV can get abused in anyway.

    Looking online and seems that LG have a 2 year parts guarantee so I'm going to follow up on that too.

    But why it hasnt lasted a reasonable time is key. If its through misuse or wear & tear....its not inherently faulty. The fact it hasnt lasted reasonable time isnt enough on its own.

    A tv can be abused in a lot of ways :P Most common is probably leaving it on standby for long periods of time. LG 2 year parts guarantee will probably still see you paying for labour.

    Give richer sounds a call and give them the details, they may offer to have a look at the tv for you - saving you the cost of a report. If they refuse to do anything, ask them what proof they require that the fault is inherent.

    Majority of new TVs can only be left on standby unless switched off at the plug, they are designed to be left in standby - not like the old days when they still used the same amount of power.

    Its never been abused in my view, in fact the usage is very low as we manily use/watch the TV in the play room with the kids so although I've had it 19 mths its probably only had about 6 months of usage which fuels my thinking that it was not fit for purpose.

    Went into the shop yesterday but I dont think they are open to doing anything more than repair at my cost although never got to chat to manager as he was not on the floor at the time.

    I did manage to get a chat with a TV repair guy today who said that its a straight forward repair and hes done a few of them and repair would be around the £80 which isn't the kick in teeth I initially thought so I may just go and get it done to save on the hassle factor although I may still call RS and speak to the Manager to see if he's willing to be customer friend #1.
