Get your appeal in ASAP, concentrate on which descriptors you think you qualify under, ignore -for now- the innacuracies of the ATOS report, you can make a complaint about that later on.

Appeal rules are changing very soon (end of this month) if you appeal now you should be paid on the first stage if you appeal later on after the rules change you won't be paid on the first stage.

You need continuous sicknotes on appeal.

You will only get assessment rate on appeal and only for a total of 1 year from December 2012. after December 2013 when payments stop if you wait 13 weeks and submit another ESA1 form for conts only you may get paid again for another 1 year. however, most DWP staff do not know this is possible and will tell you you can't do it. Just ignore them and submit your own ESA1 at 13 weeks and wait for it to be processed. and ensure when it is processed that different tax years were used. from your current claim.
