Can he change from Cont ESA to Inc ESA?

    The income disregard for IR ESA is £20/week - not £10..
    It is £20 if it is your own income, I thought there is no disregard if it is your partners income, but as Mikey said it ....that's why I worded it the way I did.

    Takes about 2 - 3 weeks to process an ESA3, which you don't have to phone for, you can pick up at a jobcentre.

    Does he get DLA Care? low, middle or high?

    If you give up your job your NI payments will stop, they won't be paid by his ESA IR claim.

    She would have home responsibilities protection though from the child benefit? So shouldn't affect her entitlement to state pension?

    It does mean as you say she would not be able to claim NI related benefits for future periods.

    Hello again
    We have tried previously for DLA and were last week given yet another claim pack by my Husbands advisor when he went for a work focused interview - hopefully this will be third time lucky. He also has a new Doctor who is helpful and concerned and really wants to help him, I hope it works this time, the last Doctor he had didn't give a damn and left the practice when he didn't get the promotion he thought he should have got apparently. Also our MP has said they will try and help to get him into the support group if possible.
    I don't think I am bothered about the NI related benefits really, it seems the income based ones are far more beneficial - as we now know you get nothing for working all your life!

    If she gets child benefit now and it's in her name, then, fair enough she will get NI credits, but when that stops the NI credits will stop. Maybe by then she will have worked out a way to continue to get NI paid be it working or benefits.

    Your NI needs to be paid to make sure you get a full pension when you retire.

    Don't hand in your notice until you get some specialist advice on this. Your MP is not in a position to know if your husband should qualify for the Support Group, in fact he probably knows less about the criteria than you do. Focus on finding someone that knows their stuff, your MP is going to be of no great help to you.

    To clear up a common misconception, the forms are not designed by ATOS, they are produced by the DWP. This is somewhere that your MP does have input, if he wanted to he could take steps to get these forms changed. Sadly, as he is a Conservative, I doubt he'll want to do that.

    Its ten pound disregard for partners wages.
    Industrial Injuries gets taken in pound for pound
    but help with the mortgage would kick in straight away if entitled the thirteen weeks has already been served...
    Or you can ask for twelve weeks backdating

    As said, if you make a claim now, and dont give up your job at least you will see if entitled in June

    Working you will be £10 better off as a couple on ESA IB of course you incur work expenses, but only you can make that decision to give up your job....

    I do agree with Thomas on this. MP is not in a position to get one individual put in the Support Group.

    I wouldn't give up your job without getting more specialist advice.

    Have you considered any other form of transport, like a scooter or something as a stop-gap? Presumably you have no work colleague who you could share transport with?

    Thank you all very much for your replies.
    We don't get free prescriptions, I buy a 3 month card for my Husband - he has 5 items a month, but I pay for 1 item for me.
    I had also thought about a scooter but to be perfectly honest, it is a 20 mile round trip - all of it on a B road - 60 miles an hour limit and it is unlit. We live in a rural area. I don't think I would survive for a week especially in the winter! I just about feel safe in a car, let alone on a scooter.
    I will call into the JC on Tuesday/Wednesday for the forms and also will ask to make an appointment with the disability advisor.
    You are correct in thinking that my MP knows nothing - he kept asking me where I had got my information from and I told him the Governments own Impact Assessment!!!!!!!!!!!! I told him to read the blog Diary of a Benefit Scrounger!
    My other option is to go self employed, I have an idea that I have been putting together for the last few months and while I don't think I will be appearing on Dragons Den any time soon I think it would bring in a decent enough income - probably the same as my job or a bit more obviously without the transport issues.
    I would appreciate it if anyone can suggest where to look for advise on going self employed and if there is any help available.

    If conts WRAG or conts SG it is the same deal. You can either get free NHS if you have an ESA IR top up or if you apply successfuly using an HC1 form.
