Store Cards Reclaim... Is this ok to attempt yet?

I had previously attempted this before when the credit card reclaims first came out and I was told by the company in question (Style) that there was no OFT ruling on store cards only credit cards.

Just wondered if anyone new the status of this now, has that changed or are store cards still off limits.

I never pushed it to court with them years ago because of the lack of OFT ruling I was scared I would lose.

Store cards are a form of credit card and fall under the consumer credit act the same way.

A complete waste of time if you tried it. It was just something some dodgy claims companies thought they could make happen before they ran off with many millions of pounds of gullible consumers money.

The success rate is single digits. Even if the court rules the contract is unenforceable, you still owe the money. The store card company would just not be able to use to courts to get it off you. They will be allowed to register it as a debt in default and as cards are open ended, they could keep it on your credit file for a very long time. That would destroy your ability to get credit in future. That could also stop you getting mobile phone contracts and monthly car insurance as well.

The style card is over 10 years old, maybe more. The account had no debt on it I was asking about reclaiming late payment fees and so on in the same way you can with credit cards.

I actually followed the guides on this very site about 5 years ago and got cash back from capital one and Halifax for the same charges. I remember though in the article it said store cards where a different ball game.

So my question relates to any changes in that but I guess not
  • Hi there,

I wrote to New Look about default fees about a year and a half ago and didn't hear back at all. The New Look card is operated by Ikano who I think do a lot of the other ones.

Anyway I sent all the info to the FOS who said that the lack of response wasn't final enough for them to get involved but they prompted Ikano to reply.

Anyway today I got confirmation that they would pay me the costs plus interest, but would deduct fees they paid to an external agency due to my late payments. Oops.

So now need to think whether to accept that. I guess it is reasonable. I'll keep searching the forum to see if someone else has had this happen.

Anyway, I think it's definitely worth trying again with your Style card!

    Good luck.
