    If (and it's a big if) he was only asked about convictions (rather than convictions & pending convictions) at the proposal stage then he's in with a chance of getting it over turned.

    It would be highly unusual for an Insurer not to ask for any "pending" convictions as well as convictions as it's standard in the market. Any Insurer not asking for pending convictions would end up with a book of business top heavy with undisclosed pending convictions (As their prices for these would be lower) and would notice fairly quickly when the first few came up in the claims process.

    Note that the duties of the FSA with regards to insurance have been taken over by the Financial Conduct Authorityhttp://www.fca.org.uk on April 1st. Also note that the duty of care owed by a consumer customer (i.e. insurance that is not mainly for business) to the insurer will change on the 6th of April with when the http://www.legislation.gov.uk/ukpga/2012/6/contents Consumer Insurance (Disclosure and Representations) Act 2012 comes into force.

    Except, that's been industry practice for quite some time now.
