Quick Divorce

Hi,

My wife and I have agreed to a divorce and while we are on talking terms and the situation is amicable I would like to have the division of assets drawn up along with divorce papers.

I have noticed a few websites which offer divorces for quite cheap, they also charge a management fee but not sure if they are the best way to go forward. They have been hounding me since I originally called, which seems more like a commission based company with sales targets. Any company like that always leaves me feeling a little unsure. Has anybody has any good experiences with them?

My wife have agreed that the division assets would be as follows;

1) She moves out and I stay in the property. (This is her choice as she wants a clean break)
2) Her name is removed from the mortgage deeds within 5 years (this gives me time to either sell it, increase my earnings for me to be able to apply for the mortgage on my own) If worst comes to the worst I can house share.

Again with the point she has said that she is happy to sign it over within five years.

3) She will not force the sale of the property at any point and will not ask for any more money.
4) I pay her nine thousand pounds for her share of the property.
5) The car (fully paid) which is in my name will be signed over to her.
6) She is happy not to take any furniture as the property she is moving into is fully furnished.
7) I pay for the divorce in full
8) We agree to £50 for my son who will spend 4 days a week with my wife and the other with myself.

I have understood that there is something called a clean break which can be put in place. My worry is that in a years time she may decide she does not want to ever sign the house over and will eventually force me to sell it. Would she be able to do that?

    1) there is no such thing as a 'quick' divorce. It takes as long as it takes.
    2) Without further details of your length of marriage, ages, pensions, earnings, value of house vs. value of mortgage, debts etc. it is impossible to say whether your proposal would be considered 'fair' by a judge and therefore signed off.
    3) You can agree child maintenance within a Consent Order but after one year, your wife can go to the CSA and they will take on her case. You should check rates using their calculator and make sure that your offers are broadly in line with their calculations if you want to keep them out of your life (highly recommended).
