Myself & Fiance entered an IVA in april 2007 which i was paying every month without fail until june 2008 when my direct debit was getting returned to my bank account without no reason,
i let it go for 1-2 months and after trying to contact the IVA company(simple debt solutions) i originally set up the IVA with,
i was getting no joy of communication whatsoever. In and around this time i moved house (rented) and stopped paying the IVA comapny as stated (getting returned). Until this day have not had a letter of correspondance of any kind and ive checked my own and my partners equifax and experian credit reports and both CRAs states SETTLED in june 2008 (odd).
I recentlly went and spoke to local CAB advisor and he checked the IVA register to which there is no entries of myself or my partners information on the register. Im curious on what to do next as the IVA states settled ans mentioned above and will drop off our credit files in April 2014, can anyone advise me on what to do next please, (shall i just leave it or get in touch with anyone) as im currently trying to get my credit file in order and move on with my life............

thanks for any positive responses in advance :)

I had an issue when i applied for a DRO in 2011 after a relationship breakdown, that the join debts with my then partner i went to include had 'vanished' from my file, the CAB advisor rang the company whilst I was present to be told that they had no outstanding account in that name, she told me that I should not worry about that debt as it is their responsibility to prove you owe the amount, and they had no proof. I am yet to hear anything from the company involved.

This was back in 2011 so things could change, I would contact the CAB and seek advice from them on the matter as they give free advice and don't advise to gain money like some debt solution companies do.

  • Hi Howie

For what it's worth, I would strongly recommend that you get a note from CAB to state they have checked and find no record. Then keep all your records from June 2008 to show your S orders were being returned. In effect, keep everything to show you were not in breach of your IVA. That way, should it rear its ugly head in the future, you can show you did your best to maintain the IVA and any breach of contract is down to your creditors and IP, not you. Do this and there should be no comeback. I assume you are now past your final repayment date so I would be inclined to just store these records and enjoy your good fortune. I suspect, someone forgot to 'post' the original agreement or register it correctly and your IP took the hit and had your debts written off.
    Happy days!

Thanks for your wise words, i have kept all relevant information my start date was around 5th May 2008 so im hoping all will leave my credit file when 6 years lapse and that will be that, i have litterally checked the IVA register again and nothing found, and as mentioned by yourself i will visit the CAB and get this confirmed in writing...
