Foreign SIM card purchased - not as described.

I purchased a SIM card for Thailand from a travel sim website. They sold it to me advertised with 3GB of Data preloaded - the only reason I got it. It was £25. A sim with no data would have cost £10.

When I got to Thailand the data wasnt working. After emailing back and forth for a while they said the credit had not been loaded and it would take an hour or so to do. After a few hours nothing so I emailed again and they said it could take up to 8 hours. The next morning there was no credit and by this point I was getting quite annoyed. I therefore decided to find somewhere to get it topped up myself.

Had I known I would have to do this I would have just got the SIM card here myself. I demanded a full refund. They refused despite several requests and only refunded 50% - meaning, I still paid more than the £10 they were charging in the first place!

This is a UK company so does anyone here know if I can take this further? Obviously there was no way of me knowing that the SIM card was not what I wanted until I arrived in Thailand and put it in my phone.

Can I still return it? Do I have the right to a full refund?

    If they refunded 50%, for the sake of £2.50 is it really worth it?

    Hi and thanks for the responses.

    I paid with a cc through PayPal.

    It's not about the £2.50. I bought the sim in the UK for the convenience of having one working when I arrive. Instead, I had no working phone for a day then had to go to top it up myself (where I could have just bought a sim anyway)

    I just want to know what my rights are considering I had no way of knowing until I opened it and put it into my phone that it wasn't working. I really don't think a 50% refund is fair as I didn't get what I paid for and was only aware of this once I arrived in Thailand.

    Its not about the 50% though is it, it wasn't as described or fit for the purpose so a full refund is what the op wants. for £12.50 is it really worth it, is what you mean.

    Just to clarify: I would never have bought the SIM card in the first place had I known it had no credit and was only interested in purchasing a Pre loaded one

    But it would've cost the OP £10 for a SIM anyways, he just paid a further £15 for 3gb preloaded (at least, thats how i read the OP). A full refund would be a betterment, not simply putting OP back in position he wouldve been in had the breach not happened.

    The top up was 700 tbh which is about £15 anyway.

    I appreciate financially I would be better off if I get a full refund but bottom line is they didn't give me what I purchased, I was inconvenienced with no working phone for a day and I was inconvenienced having to find somewhere to top up. The whole point in purchasing the card in the UK was FOR the convenience!

    I would happily return the SIM card to them. Only problem is that it was for an iPhone 5 so they had to cut it for me to micro size.

    They messed up. I trusted them as they looked reputable and to be fair they did try to sort it out.

    imo whatever it cost you to top up, you should be refunded as that puts you in the position you would have been in had the contract been performed correctly. If this was more than 15 GBP then you're still due £2.50 + however much it was over £15. If it was less, then £2.50 - however much under it was.

    While I appreciate having to go top up was a hassle and defeated the purpose of getting that particular SIM deal, ultimately inconvenience isnt something you can claim for unless there is a monetary loss incurred. Although you do have a duty to mitigate your loss.

    Maybe try firing off another letter/email to them, but personally if it were me I'd focus my energy elsewhere if they dont respond and vote with my feet in future.
