They cannot use that as excuse not to submit the popla code, as I said previously if this person didn't know what further information to give. It's on the parking company to either accept or reject the appeal within 35 days.
No grey area, no messing around, it's in the code of practice that it must be either one or the other. If they fail to abide by that CoP by not giving the decision that is their problem. If it went to court it's there in black and white, you must either reject or accept the appeal within 35 days.
A judge would see it in that way. Not in some vagueness by this company
I agree entirely with that. The POPLA web site is, as you say, explicitOn receipt of your representations, the operator must:.Consider any representations received within the time allowed for representations;
Acknowledge or reply to the representations within 14 days of receiving it;
Decide whether to accept or reject the representations;
Within 35 days of receiving the representations, accept or reject it and inform the maker
I am happy to concede that, as your thread is laid out, the PPC has failed to reject your appeal so far and, unless they do within the 35 days of your representation, they will be timed out. So apologies to Stroma for my error. :beer:
The point about a PPC having to supply a POPLA code automatically or demanding you should ask for one in the previous posts is another matter that I still stand by, but is not yet applicable in your case.
So, keep a calendar on 35 days from the date of your appeal and hope they don't reject your appeal before then. If they do, then please let us know what they include re POPLA.0
