Hi
If you are looking to claim under legal cover on an insurance, is it normal to claim on the year the incident happened, or the year you are going to claim- if these are different?
If any one could point me in the direction where I may be able to find the answer that would be great.
TIA

You need to use the policy that was in place at the time of the incident giving rise to loss or the date of knowledge of the loss.0

Thanks very much, I thought it may be like that in line with when claims can be made.
However as always its slightly more complicated.
Incident at work happened aprox 18 months ago, resulting at the time of a stay in a specialist unit, and follow up apps's at specialist unit.
Now ongoing Drs appts for pain and more recently PTSD, it was at this point (PTSD), that we have decided we will probably claim.
However as part of the claim may inc physical suffering, im sure we will be told to claim from the time of the accident!
Thanks for your reply and time!0 -
Im quite sure at the time we didn't have legal cover (trying to be money saving and thought we wouldn't need
). Will dig out policy and check.
After the shock we got in place legal assistance, life insurance policies, wills etc.
So wanted to check if we could claim on current, as cant face no win no fee lawyers (I dont know why, TV adverts put me off)!
However will need to get over that, if this is the route we decide to take.0 -
Your claim starts with being injured in the first place, the PTSD etc is a consequence of being injured (more than likely although of course I do not know the full facts of your case).
You are better off with a no win no fee lawyer, but you are also better off doing something about it tomorrow as there are significant changes about to occur and ideally the lawyer could do with getting you to sign a no win no fee agreement and also take out any relevant After The Event insurance (assuming you do not have have legal cover) tomorrow as lots of rule changes happen on 1st April (over the easter weekend) and this could have an effect on whether you have to pay any contribution towards your legal costs.
If you can see a local injury solicitor tomorrow it would make sense to.0 -
