Fraudulant pay slip??

Hi, just wondering if anyone could offer me some advice.
I split with my husband and while going through paperwork I came across a few payslips in my name. They are from his business stating that he has been paying me £2000 a month after tax.... For 1 hours work. All my details, name, national insurance number etc.
I have never once received a penny of this. I was down on his company as secretary but didn't get any payslips as I didn't actually do any work. I didn't really understand the business side, his company so he dealt with all of that.
My question is, will this effect me when i go back to work once the kids are old enough. I'm on my own now and he refuses to pay any child support and ignores the csa letters and phone calls.
Am I able to somehow get this money from him that he says he's been paying me for working for him. I have bank statements that prove I haven't recieved a penny.

This sounds like tax avoidance rather than tax evasion.
Was he paying you as an employee, and if so was tax and NI paid on this income?
Did you not benefit from his business income whilst you were a family?0 -

I'd contact the tax office and then a lawyerWe’ve had to remove your signature. Please check the Forum Rules if you’re unsure why it’s been removed and, if still unsure, email forumteam@moneysavingexpert.com0 -

They were married, they were both part of the business - what she has described is very common in small businesses. She needs to give more information before anyone can state this is "dodgy" or not - they also need to establish their own liability in this.
OP, does he still have the business and are you still company secretary?0 -
It states that tax and national insurance was paid on this.
As for benefitting while we were a family... Yes we had some nice holidays... But he also lavished a lot of money on other women... And also illegal things. Hence the reason I left him.
I'm fully aware that I might come across as wanting to screw him over as the ex wife, but that's not the case so please don't think that it is. I'm trying to start afresh. I have 3 kids a a whole house to furnish, not to mention debts of his which I'm liable to pay... And he is mor than happy for me to do so!
I want to know where I stand for when I return to work and if I'm able to get this money off him that he claims he's paid me.Started Comping September 2012

Married or not I would have thought if there is a payslip and tax and NI in your name then you would have been paid it or liable for the tax and ni shown on it.Thomas_Hardy wrote: »They were married, they were both part of the business - what she has described is very common in small businesses. How is it tax avoidance or tax anything when the OP says that the wageslips shows what was being paid after tax?? Thus implying he may have actually been paying her from the business for just being a SAHM, with an minimal amount of work actually needed... sounds a good job at the time!Thomas_Hardy wrote: »This sounds like tax avoidance rather than tax evasion.

Well if there are payslips for you , where is the £££?size0wannabe wrote: »It states that tax and national insurance was paid on this.

He would have to prove he paid you like any company would have to.
Did you have a separate bank acct to him? We’ve had to remove your signature. Please check the Forum Rules if you’re unsure why it’s been removed and, if still unsure, email forumteam@moneysavingexpert.com0 -
But were you not benefitting at the time from money coming into the household?
When did these payments stop? if this tax year any scope for a tax rebate??
If the Tax \ NI has been paid through PAYE then would look like was a paid SAHM - with the wage being paid into the home costs rather than direct to your bank..size0wannabe wrote: »I have bank statements that prove I haven't recieved a penny.0 -

I don't think you come over as wanting to screw him over, but it does seem you were naive in not taking an interest in the business.
By all means pursue him for the money, but I would expect such a legal challenge to cost more than you would benefit. He would argue you did receive the money, albeit not into your own bank account.
Before pursuing this you need to be aware of everything that has gone on in the business. If there has been illegal activity, remember you were a named company officer.
If it was me, I'd accept that he was a t*sser and write it off to bad experience.Married or not I would have thought if there is a payslip and tax and NI in your name then you would have been paid it or liable for the tax and ni shown on it.
In theory, yes. However the reality of the situation is quite different.0 -

Because that salary is tax deductible
Well if there are payslips for you , where is the £££?
He would have to prove he paid you like any company would have to.
Did you have a separate bank acct to him?
Again, not that simple.0
