Entitled to full refund?

Hey all :)

We bought 3 x 7" computer tablets for niece and nephew but 2 of them became faulty after about 4 weeks by not charging and getting very hot and finally culminating in them not turning on at all.

These were duly replaced and we were reasonably happy with the service from the retailer but these 2 have also got faults! One has a power button that you have to press so hard for it to register I struggle to turn it on or off, let alone the 5 year old it was meant for and 1 where the screen is very loose and doesn't appear to be stuck down properly.

We've written to the supplier and said we've got no confidence in these tablets now and have requested a full refund on the 2 faulty ones as not of satisfactory quality. They have refused this due to the age of the original order (ordered week before xmas) and have offered replacement but as mentioned we have no confidence in their quality. Out of the 5 we we've had in our possession only 1 has been OK ( and even the charger of this had to be replaced ).

Can I demand a refund or do I have to accept their offer to replace?

The little ones are getting quite upset we keep having to take their tablets from them!

    Once acceptance has occurred (which it most likely has), you can request (not demand) a repair, replacement or refund (which can be partial to take into account use you have had of the goods) but the retailer can refuse your chosen remedy if it is disproportionately costly compared to another remedy.

    If the fault persisted through replacements etc, then it may give you grounds to reject but I think you may struggle at present as it is possible perhaps they were just part of a bad batch.

    Give it a chance and see how it turns out.

    Have you done an online search to see if it is a common problem for this model, or do you stand alone? The maxim of you get what you pay for holds true, so if kids are rough and it fails, there is no possibility of claiming they are not fit for purpose.

    Do your homework - and if there is a common theme coming to light, use it to your advantage when negotiating.

    unholyangel, apologies for using the word demand; it is quite a strong word and probably not warranted.

    Buzby, they were cheap yeah; that was their main attraction given their target audience and some reviews do hold them in a negative light but for the most part they're praised.

    I've had time to think about it now and to be fair the retailer hasn't done much wrong really; they've replaced the first 2 faulty ones without question and offered to replace these 2 also, it was just we've now lost all confidence in product.

    They have offered to speak to the manager once the goods have been returned to discuss the possibility of the refund.

    I'm happy with that and I'm actually going to apologise via email as I was on my high horse yesterday and in hindsight this wasn't deserved.
