Whoops! Paid a cheque payable to my wife into my personal account, what next?

Just wondering what happens next? Will they just return the cheque to me?

    If they notice, they'll post the cheque back to you.

    If they don't notice, then it'll just go into your account like any other cheque.

    You could end up being prosecuted and convicted of fraud. Attempting to convert a cheque is not to be mocked at. But on a genuine note it will probably go unnoticed.

    A bit extreme - I really wouldn't worry about seeing Special Branch in a dawn raid! Look up mens rea. Just because an act is technically unlawful, it doesn't make the perpetrator a criminal. As always the burden is on the prosecution to prove, beyond reasonable doubt, that not only was the act criminal, but that the perpetrator also had a "guilty mind".

    To the OP - interesting that the bank flagged it. Did you put it in an ATM? Banks are hotter on checking ATM deposits these days. All those HMRC tax refund cheques that go 'missing' in the post each year have to go somewhere, after all!

    See far more cheques made out to HMRC that go missing and only get found out several months later when the person is chased asking where their payment is......

    Not always, some crimes (including this one) are strict liability offences.
