PPi Claim against Citroen Dealer (10+ yrs Old)
cjj2013
Hi
I have written directly to the citroen dealer end of last year with regards to my msiold PPI when i purchased a car back in '96, they replied back saying as the dealership had been bought out it is no longer their resposibility to deal with this.
I forwarded the complaint onto the F.O.S last month and received a letter this morning saying that as the PPI was misold prior to 2005 and the company were not a member of the GISC or MCCB they cannot may not be able to help with my claim.
They have said that I can complain against the underwriter of the PPI policy and to forward any policy booklets and info. Due to the time lapsed and i do not have these documents.
Is there anyway i can still persue this claim and if so what information can i provide the F.O.S to ensure this claim can be rectified.
Thanks

You can't provide any information to FOS now as they have no power to intervene with complaints about car finance prior to 2005. FOS are merely suggesting that you might have better luck pursuing the underwriter of the policy, but you'd need some documentation showing who the underwriter was in order to proceed further with this especially as the original dealer no longer trades. Is there anyway i can still persue this claim and if so what information can i provide the F.O.S to ensure this claim can be rectified.0 -

That is the standard response from the FOS. It doesnt mean the underwriter has liability. It is basically a last chance saloon and in the majority of cases you would expect failure. Success on this front requires an unusual set of circumstances but there have been a small number of cases where it worked. Is there anyway i can still persue this claim and if so what information can i provide the F.O.S to ensure this claim can be rectified.
You dont have any right of access to the FOS as you bought prior to regulation (which started in 2005). You also dont get any access to the FSCS as it is pre-regulation.
This is game over unless you can identify the insurer and even then you have probably under 5% chance of success. and that assumes documents still exist.I am an Independent Financial Adviser (IFA). Hi, I am in the same position as cjj2013, I had three credit agreements with Citroen in 1993, 1994 and 1995. I called a number I found for Citroen Finance today and it went through to Peugeot. They put me through to their PPI team who said their company was only set up in 2002 so they can't help. The dealership I used is no longer in operation. Any ideas? Thanks!0

Read through the thread (from last year), specifically the following excerptAny ideas?"I forwarded the complaint onto the F.O.S last month and received a letter this morning saying that as the PPI was misold prior to 2005 and the company were not a member of the GISC or MCCB they cannot help with my claim".
Basically, any complaint you make can be rejected simply because the sale took place before regulation. You cannot refer pre-regulation complaints to the Ombudsman.
These sales were two decades ago.0
