CMS Parking Fine - Wickes Warrington

I parked in Wickes carpark in Pinners Brow Warrington. Parking notices say 2 1/2 hrs max stay whilst shopping. I didn't have any cash, so went to bank, withdrew money, came back to shop, bought the timber from Wickes.... and when I went to put timber in the car, found a ticket on my windscreen from CMS UK Ltd. demanding £90 for "leaving site". All of this took 30 minutes.

I've filled in the appeal process on CMS webpage and forwarded details to Wickes customer services (Wickes staff couldn't help and it was clear from their reactions that this was not the first time this had happened), but what should I now do? Can I just ignore any notices/letters demanding payment?

    As you have "appealed" this invoice (its not any kind of fine!), you may as well wait for their inevitable rejection, then make a further appeal to POPLA once you get the code off CMS.

    If POPLA turn you down, then simply ignore that altogether. :)

    When you get the rejection please post here what you are thinking of saying in your POPLA appeal, as it's not straightforward. You need lots of legal stuff IMHO to trip the PPC up and hopefully win at POPLA.

    If the PPC reject but do not give you POPLA as an option then they are stuffed - which would be good!

  • Well there you go:

    A combination of stating in my appeal that I was happy to pursue the matter further from my side if they persisted, and a call from Wickes customer services to CMS to explain that I could prove (by way of till receipt) that I had been a customer in the store at the time of the notice, and CMS have (not surprisingly) reviewed their information and agreed to not pursue the matter any further.

    Cheers guys - It's always helpful when these things happen to get advice from people who've 'been there - done that' .... :beer:
