Hello everyone,

PEPIPOO THREAD HERE: forums.pepipoo.com/index.php?showtopic=77713&st=0&gopid=801423&#entry801423

(had to put broken link, add http:// to above)

There is a controlled zone section of Sydney road near my home in Sutton, Surrey, the sign says "Controlled zone!Mon, Sat!8:00am - 6:30pm" and has single yellow line. On this section of road, there are about 5 or 6 of council marked white dotted line parking bays!half on road & half on a footpath!but the road has further space for 2 more cars but no white dotted lines. Nearby residents can buy residents parking permits for these bays from council for!£60 odd pounds per year. I have not bought the yearly residents parking permit although I live nearby.

I parked my car just behind a car which was in white dotted space but where I parked there was no white dotted space, so I was parked half on footpath & half on road just like all the other cars were parked there but they were in the white dotted spaces & I was not.

This happened on a sunday at 7:18 pm & I parked there temporarily since i had my pregnant wife in the car & there were no other spaces left anywhere on the road & my wife wasn't feeling well so I didn't wanted her to walk a lot to home.

I returned later & found a vacant free parking slot on road and moved my car there but didn't notice any parking tickets until next morning.

The ticket mentioned my car registration correctly but incorrectly mentions my car "Colour: Black" while my car's colour is green.

Also observation time was just 1 minute:!"observed from 19:21 to 19:22" issue time: 19:22

The ticket says: "Contravention code: 62 Parked with one or more wheels on or over a footpath or any part of a road other than a carriageway.!A penalty charge of £110 is now payable (reduced to £55 if payed within 14 days)."

The council has rejected my informal appeal.

My questions are:
1) Does the fact that there is a mistake on the PCN (Car colour says Black while its Green) can win me the appeal?
2) Can I win on mitigating circumstances?!
2)!Should I take my appeal to court?
3) Do I have a case?
4) What are my chances of winning?

Any response/advice/help will be much appreciated since I have recently been made jobless due to company insolvency!

    1) car colour is irrelevant
    2) sometimes you can, it depends on the council
    3) penalty charge notices don't go to court, but patas or the traffic appeal tribunal
    4) with help you could win this

So on the above I recommend that you post this on https://www.pepipoo.com as well, they are the experts on council tickets, they will need to see a scan/photo of both sides of your PCN scrub personal details from that image. Then post it up to https://www.photobucket.com for free. Then post the link in the new thread that you create in the council forum.

Definitely appeal using mitigating circumstances although as Stroma says, wrong colour is irrelevant.
